§ 32.10 CARE CENTER COMMITTEE.
   (A)   The Mayor, by and with the consent of the City Council, shall appoint a Municipal Care Center Committee to act in an advisory capacity and an oversight function between the public, the residents and employees of the Care Center Committee and the City Council. The City Council shall retain the capacity to make final decisions in regard to the final operation and financing of the Municipal Care Center. However, the Committee shall regularly meet and hear concerns among the citizens, residents and their family members, and employees of the Municipal Care Center to develop policy and act as an oversight committee to advise the City Council in regard to decisions in the operation and financing of the care center.
   (B)   (1)   The Municipal Care Center Committee shall consist of five members who are all residents of the municipality. The first appointed members of the Committee shall cast lots at the first regular meeting of the Municipal Care Center Committee to determine the respective terms of office and shall report the results to the City Administrator. One member of the Committee shall hold his or her position for one year, two members of the Committee shall hold their position for two years and two members of the Committee shall hold their position for three years, from the first day of December, following appointment.
      (2)   All subsequent appointments shall be for three years, except to fill vacancies. After the lots have been cast and the determination of Committee members’ terms completed, the members of the Committee shall choose from its number a Chairperson and a secretary. It shall be the duty of the secretary to keep the full and correct minutes and record of all meetings and to file the same with the City Clerk-Treasurer, where they shall be available for public inspection at any time. The minutes of each meeting shall be published in a legal newspaper of general circulation in the city within 30 days after the meeting is held. The Committee shall meet at least once per month or more often, as is required to conduct business. The majority of the Committee members shall constitute a quorum for any meeting and resolution or recommendation given to the Mayor and the City Council.
      (3)   All actions of the Committee shall be subject to the review and supervision of the Mayor and City Council. The Committee shall be responsible for making such reports and performing such other duties as the Mayor and City Council may, from time to time, designate.
   (C)   The position of any Committee member shall be vacant if he or she no longer resides within the city limits, or if he or she is absent, and the absence is not excused by the Committee for five consecutive regular meetings of the Committee. The Mayor, with the consent of the City Council, shall fill any vacancy by appointment of a new member for the Committee to fill the unexpired term.
