(A) There is hereby created and established a Shade Tree Commission for the village in accordance with R.C. §§ 727.011 and 715.20.
(B) This Shade Tree Commission shall consist of the following six members: Village Administrator, a member of Village Council, and four persons, citizens and residents of the village, who shall be appointed by the Mayor with approval of the Council.
(C) The term of the four persons to be appointed by the Mayor shall be three years except that the term of two members appointed to the first Commission shall be only one and two years, respectively. In the event that a vacancy shall occur during the term of any member, his successor shall be appointed by the Mayor for the unexpired portion of said term.
(D) Members of this Commission shall serve without compensation.
(E) The Commission shall have the power to study, investigate, plan, advise, report and recommend to Council, the Village Administrator or Mayor, any action, program, plan, or legislation which the Commission shall find or determine to be necessary or advisable for the care, preservation, trimming, planting, replanting, removal, or disposition of trees and shrubs in the public ways, streets, and alleys.
(F) The Commission shall choose its own officers, make its own rules and regulations and keep a journal of its proceedings. A majority of the members shall be a quorum for the transaction of business. All plans, findings, advice, reports, and recommendations made by the Commission shall be in writing and designate by name those members of the Commission approving or concurring therein, and members who do not so approve or concur therein shall have the right, as part of such report, to state their reasons for refusing to approve or concur.
(G) The Commission when requested by the Council, the Mayor, or the Village Administrator, shall consider, investigate, make findings, report and recommend upon any special matter or questions coming within the scope of its work.
(H) This section and the rules and regulations as established by the Shade Tree Commission shall conform in such a manner as to not make null and void all existing polices and procedures identified by ordinance or policy of the village. Upon a recommendation by the Shade Tree Commission to the Village Council, the Council shall make the determination to pay for, share, or assess the cost of the care, preservation, trimming, planting, replanting, removal or disposition of trees and shrubs in the public right-of-ways, streets, or alleys.
