§ 75.39 REGULATION OF MOTORIZED FOOT SCOOTERS AND SCOOTERS.
   (A)   Definitions.
      (1)   MOTORIZED FOOT SCOOTER.  
         (a)   A device with no more than two 10-inch or smaller diameter wheels that has handlebars, is designed to be stood upon by the operator, and is powered by an electric motor that is capable of propelling the device with or without human propulsion.
         (b)   For purposes of this section, a motor-driven cycle, a moped, an electric-assisted bicycle, or a motorcycle is not a motorized foot scooter.
      (2)   MOTOR SCOOTER. Under this section, any vehicle defined as a motor scooter by R.C. § 4511.01.
   (B)   Prohibitions.
      (1)   Motor scooters.
         (a)   Motor scooters are prohibited from operating on the public streets, alleys, and public parking lots unless they are in compliance with Ohio's required safety equipment standards, property titled and registered with the State of Ohio. The operator of the motor scooter must be properly licensed.
         (b)   Motor scooters are prohibited from operating upon public sidewalks.
      (2)   Motorized foot scooters.
         (a)   Motorized foot scooters are prohibited from operating upon any public street, except for the purpose of crossing a street in a crosswalk or in the absence of a crosswalk as near to the intersection as possible.
         (b)   Motorized foot scooters will be permitted to operate upon public sidewalks, alleys and public parking lots.
         (c)   Motorized foot scooters may not be operated at any time from a half hour after sunset to a half hour before sunrise without reflectors of a type approved by the State of Ohio for the nighttime operation of bicycles.
         (d)   Operators of motorized foot scooter are required to wear a U.S. Consumer Product Safety Commission (CPSC) approved bicycle helmet.
         (e)   Motorized foot scooters are to yield the right-of-way to pedestrians on the sidewalks.
   (C)   Penalty. Whoever violates division (B)(1) is guilty of a minor misdemeanor on the first offense, and a misdemeanor of the third degree on each subsequent offense, and whoever violates any other provision of the section is guilty of a minor misdemeanor and shall be fined up to $150.
