(A) Should accidental spills occur, the residue of such spills entering the village's sanitary sewer system (and subsequently being conveyed there-through to the village's wastewater treatment facility), the person or entity responsible for or having knowledge of such spill will immediately attempt to notify (in the order of precedence listed) the following individuals of said spill until one has been contacted:
(1) The Wastewater Treatment Plant Superintendent
(2) The Village Administrator
(3) The Mayor
(4) The Police Department
(5) A Member of the Village Council
(6) The Clerk/Treasurer
(B) If accidental spills that enter the storm sewer or elsewhere in the environment occur, the user should immediately contact the Minster–Jackson Township Fire Chief or his or her designated representative. Employers shall ensure that all employees who may cause or suffer such a discharge to occur are advised of the emergency notification procedures.
(C) The notification will contain as much information as is available at the time, and such information should be updated every 30 minutes, as to the type of material spilled; whether it is solid, liquid, or gas; whether the spill is continuing or has been controlled; the name of the person reporting the spill and the telephone number that they can be reached at; and the address and location of the spill. The purpose of this spill notification is to reduce any damages to the sanitary sewer system and/or wastewater treatment facility and to reduce impacts on the water quality of the receiving stream.
(D) Within five days following an accidental discharge, the user shall submit to the village a detailed written report describing the cause of the discharge and the measures to be take by the user to prevent further occurrences. Such notification shall not relieve the user of any expense, loss, damage, or other liability which may be incurred as a result of damage to the village wastewater treatment facilities, fish kills, or any other damage to person or property; nor shall such notification relieve the user of any fines, civil or criminal penalties, or other liability which may be imposed by these regulations or other applicable laws.
