§ 52.044 TOXIC SUBSTANCES.
   The following described substances, materials, waters, or waste shall be limited in discharge to the municipal sanitary sewer system to concentrations or quantities which will not harm either the sanitary sewers, wastewater treatment process or equipment, will not have an adverse effect on the receiving stream, and will not otherwise endanger lives, limbs, public property, or constitute a nuisance. The Village Council may set limitations lower than the limitations established in these regulations if, in their opinion, such more severe limitations are necessary to meet the above objectives. In forming this opinion as to acceptability, the Village Council will give consideration to such factors as the quantity of subject waste in relation to flows and velocities in the sanitary sewers, materials or construction of the sanitary sewers and the wastewater treatment facility, degree of treatability of the waste in the wastewater treatment facility, and other pertinent factors. The limitations or restrictions on materials or characteristics of waste or wastewater discharge to the sanitary sewer which shall not be violated without approval of the Village Council are as follows:
   (A)   Any liquid or vapor having a temperature higher than 150°F (58°C).
   (B)   Any water or wastes containing petroleum oil, non-biodegradable cutting oil or products of mineral oil origin are prohibited if discharged in amounts that can pass through or cause interference.
   (C)   Wastewater from industrial plants containing floatable oils, fat or grease.
   (D) Any garbage that has not been properly shredded (see § 52.001, Definitions). Garbage grinders may be connected to sanitary sewers from homes, motels, institutions, restaurants or similar places where garbage originates from the preparation of food in kitchens for the purpose of consumption on the premises or when served by caterers.
   (E)   (1)   Waters or wastes containing toxic or poisonous solids, liquids, or gases in sufficient quantity singly or in combinations with other wastes, to injure or interfere with any waste treatment process, render treatment process effluents or residues unfit for treatment or reuse, pass through the wastewater treatment facility, cause violations of the treatment works' NPDES permit, constitute a hazard to humans or animals, create a public nuisance or create any hazard or water quality violation in the receiving waters or the public wastewater treatment facility.
      (2)   Current listings of toxic pollutants are available from the village. A list of such prohibited waste, designated as such pursuant to Section 307(g) of the Clean Water Act and amendments thereto, or as hazardous substances pursuant to Section 311(b) is published from time to time by the United States Environmental Protection Agency.
   (F)   Any waters or wastes containing odor-producing substances and any noxious or malodorous gas substance capable of creating a public nuisance, or substance causing the release of noxious or poisonous gases after discharge into the sanitary sewer.
   (G)   Any radioactive wastes or isotopes of such half-life or concentration as may exceed limits established by the Village Council in compliance with applicable state or federal regulations.
   (H)   Quantities of flow, concentrations, or both which constitute a “slug” as defined herein.
   (I)   No person shall discharge any holding tank into the sanitary sewer without first obtaining written approval from the village. Approval must be secured for each separate discharge.
   (J)   Waters or wastes containing substances which are not amenable to treatment or reduction by the wastewater treatment processes, or are amenable to treatment only to such a degree that the wastewater treatment facility effluent can not meet the requirement of its NPDES permit for discharge to the receiving water.
   (K)   Any waters or wastes which, by interaction with other water or wastes in the sanitary sewer system, release noxious gases from suspended solids which interfere with the collection system, or create a condition deleterious to structures and treatment processes.
