§ 52.003 RATE SCHEDULE.
   (A)   Establishment of a schedule of rates and charges; use of water meters. For the payment of the proper and reasonable expense of operation, repair, replacement, improvements, additions, betterments, extensions and the maintenance of the sanitary sewer system and wastewater treatment facilities and for the payment of the sums required to defray the principal and interest of all loans and/or bonds as they become due, the Village Council shall enact and may from time to time amend a schedule of rates and charges for the use of and service rendered by the public sanitary sewer system of the village, which schedule and rates and charges shall be based open the metered amount of water supplied to or discharged from a property. A copy of the schedule, while it is in effect, shall be maintained on file in the office of the village.
   (B)   Applicability of rates. Applicable to all customers served by the village's sanitary sewer system and wastewater treatment facilities.
   (C)   Availability of service. Service is available for consumers in compliance with the provisions of this chapter. The policy for extension of public sewers within and without the corporate limits of the village is contingent upon Council approval.
   (D)   Schedule of rates.
      (1)   Within the village. This schedule is applicable to all consumers located within the corporation limits of the village. The total billing for each month, or part thereof that service is turned on, shall be the sum of the following charges:
         (a)   Effective January 1, 2011:
            1.   Minimum monthly invoices for sanitary sewer usage per month is $6.50 monthly.
            2.   Customer charge per month: $3.00.
            3.   Usage charge per month: $3.00 / 1,000 gallons.
            4.   Cistern usage charge per month: $3.00 / 1,000 gallons.
         (b)   Effective January 1, 2012:
            1.   Minimum monthly invoices for sanitary sewer usage per month is $6.50 monthly.
            2.   Customer charge per month: $4.00.
            3.   Usage charge per month:
               0 to 900,000 gallons per day: $3.50 / 1,000 gallons
               900,001 gallons per day and above: $6.65 / 1,000 gallons
            4.   Cistern usage charge per month: $3.50 / 1,000 gallons.
      (2)   Outside of the village. This schedule is applicable to all consumers located outside the corporation limits of the village. The total billing for each month, or part thereof, that service is turned on shall be the sum of the following charges:
         (a)   Effective January 1, 2011:
            1.   Minimum monthly invoices for sanitary sewer usage per month is $8.13 monthly.
            2.   Customer charge per month: $3.75.
            3.   Usage per month: $4.20 / 1,000 gallons.
            4.   Cistern usage per month: $4.20 / 1,000 gallons.
         (b)   Effective January 1, 2012:
            1.   Minimum monthly invoices for sanitary sewer usage per month is $8.13 monthly.
            2.   Customer charge per month: $5.00.
            3.   Usage per month: $4.90 / 1,000 gallons.
            4.   Cistern usage per month: $4.90 / 1,000 gallons.
      (3)   Tapping charges.
         (a)   There shall be a fee of $125 per tap for areas within the corporate limits of the village.
         (b)   Areas outside of the village corporation limits that are tapped to the village's sanitary sewer system shall incur a fee of:
            1.   $2,700 for standard four-inch wastewater line.
            2.   $3,100 for larger than standard size wastewater line.
      (4)   The Village shall assess users for any additional fees, costs and expenses as may be necessary due to enforcement actions, legal fees, costs and damage from sludge discharges, accidental spills, bypasses, any special non-routine compliance monitoring, surveillance and analysis and/or other just causes applicable for an individual user.
   (E)   Delayed payment plan. Ten percent per month shall be added to the net bill if not paid in full within 15 days after rendition of the bill for said service.
   (F)   Multiple occupancy. For existing services, where multiple services are rendered through one water meter, the monthly sanitary sewer bill shall not be less than the minimum charge provided for above multiplied by the number of families, apartment units, residences, stores, offices, mobile homes, or other units receiving water service through such meter.
   (G)   Established rates applicable to properties subsequently served. The rates or charges so established shall be extended to cover any additional properties hereafter served without the necessity of any hearing or notice.
   (H)   Village subject to established rates or charges. All facilities operated by the village shall be subject to the established charges and rates for services rendered the village, and shall be deemed to be a part of the revenues of the sanitary sewer system and wastewater treatment facilities.
   (I)   Billing and collection of service charges. The sewage service charges, surcharges and fees, levied by or pursuant to this chapter shall be billed by the village or, at the discretion of the Council, by a designated agent of the Council, to all consumers liable therefor. The collection of said service charges, surcharges and fees shall be by the village.
   (J)   Lien for enforcement of collection of billed rates or charges. All such rates or charges, if not paid when due, shall be a lien upon the property served by such sanitary system, and if such charges are not paid within 30 days after due date, then the amount thereof, together with a penalty and a reasonable attorney's fee, may be recovered by the village in a civil action in the name of the village. In connection with such action, such lien may be foreclosed against such property, in accordance with the laws relating thereto.
