7-5-6:    TREE TRANSPLANTATION:
   A.   It shall be unlawful for any person who is not employed by the village to transplant any tree on any public property within the corporate boundaries of the village without having first secured a tree permit authorizing such transplantation.
   B.   Any tree transplanted pursuant to a tree permit issued by the village must be removed and replanted in a manner that is fully compliant with all applicable guidelines contained in the village's Urban Forest Management Plan, as amended from time to time.
   C.   No tree permit shall be issued for any transplantation unless the applicant submits and the village approves a three (3) year tree maintenance plan that fully complies with all applicable guidelines of the village's Urban Forest Management Plan, as amended from time to time.
   D.    Any person that intentionally transplants a tree without a tree permit in violation of this section shall be guilty of a business offense and shall be fined in amount equal to:
      1.   The appraised value of the tree, as set out in the village's Urban Forest Inventory, as amended from time to time; and
      2.   The actual costs incurred by the village to replace the tree in compliance with Section 7-5-7 of this chapter.
   Every tree so transplanted shall constitute a separate offense. (Ord. 2019-19, 8-27-2019)
