A. Maximum Weight On Nondesignated Roads: All Municipal roads shall be classified as nondesignated unless State or County designated, signposted, as provided by ordinance, or as set forth in this chapter. The maximum weight permitted on all nondesignated Municipal roads shall be five (5) tons, except for the following:

B. Vehicles With A Gross Weight In Excess Of Maximum Weight Limits On A Nondesignated Municipal Road: It shall be unlawful to operate on any nondesignated Municipal road any motor vehicle with a gross weight, including load, in excess of maximum weight limits, or in excess of special weight limits provided for by ordinance and signposted without having first obtained an overweight permit from the Police Chief or his designee.
This subsection shall not apply to the following:
1. Any road which has been designated by the Village as a construction entrance;
2. Garbage trucks, tow trucks, school buses, ambulances, firefighting vehicles, snowplows, street maintenance vehicles, local delivery box trucks (trucks with a boxlike cargo area that may or may not be separated from the cab of the truck and used primarily for local deliveries of baked goods, beverages, food, ice, milk, parcels or packages), emergency vehicles; and
3. Vehicles traveling from an origin point within the Village to a destination outside the Village, or vehicles traveling to a destination within the Village, and the origin point or destination is on a road on which the vehicle would be otherwise prohibited, so long as the vehicle deviates from the road(s) on which the vehicle is permitted by the shortest permissible route.
Except that any of the aforesaid vehicles in excess of eighty thousand (80,000) pounds must first obtain an overweight permit from the Police Chief or his designee.
C. Vehicles With A Gross Weight In Excess Of Eighty Thousand Pounds On A Designated Municipal Road: It shall be unlawful to operate a vehicle with a gross weight, including load in excess of eighty thousand (80,000) pounds on a designated Municipal road, without first having obtained an overweight permit from the Police Chief or his designee.
D. Application For Overweight Permit: Application for all overweight permits shall be submitted through the Village’s designated third-party vendor and shall include at a minimum:
1. The type of vehicle(s);
2. The weight to be transported;
3. The content to be transported;
4. The number of trips required;
5. The route to be taken by the vehicles;
6. The destination of the vehicles within the Village; and
7. The name of the carrier, if different than the applicant.
E. Issuance Of Overweight Permit: Upon submission of the overweight permit application and required payment through the Village’s designated third party vendor, the Police Chief or his or her designee may authorize issuance of the overweight permit, subject to the following conditions:
1. In consideration of seasonal or other time limitations, the Police Chief or his designee shall restrict the number or time of daily trips authorized by each overweight permit, as is consistent with the public safety.
2. In establishing the routes to be traveled, the Police Chief or his designee may establish the most direct and shortest route consistent with the public safety, taking into consideration existing traffic, the character of the road or roads, and the configuration of the terrain.
3. All overweight permits shall be nontransferable and shall be valid only for the applicant or his agent or employee and the specific vehicle listed on the application.
4. Every overweight permit shall be carried in the vehicle to which it refers and shall be open to inspection by any police officer or agent of the Village.
5. No refunds of the overweight permit fee shall be made to the applicant following the issuance of an overweight permit.
6. The applicant shall comply with all Village, State, County, and township ordinances, regulations and requirements.
7. Altering or falsifying a permit will revoke overweight permit privileges for twelve (12) months.
F. Fee Schedule For Overweight Permit, Vehicle With A Gross Weight In Excess Of Maximum Weight Limits On A Nondesignated Municipal Road: Overweight permits for a motor vehicle with a gross weight, including load, in excess of maximum weight limits but a gross weight equal to or less than eighty thousand (80,000) pounds, or in excess of special weight limits provided for by ordinance and signposted, may be applied for and may be granted in accordance with the following schedule:
1. Single trip permit: Thirty dollars ($30.00).
2. Round trip permit: Fifty dollars ($50.00).
3. Thirty (30) day permit: Seventy five dollars ($75.00).
4. Applicable transaction fees charged by the Village’s authorized third-party vendor may be added to amounts paid pursuant to the fee schedule.
G. Fee Schedule For Overweight Permit, Vehicle With A Gross Weight In Excess Of Eighty Thousand Pounds: Overweight permits for a motor vehicle with a gross weight, including load in excess of eighty thousand (80,000) pounds for single trips and round trips may be applied for and may be granted according to the fee schedule as set forth in section 9-1-1 of this chapter, to which may be added applicable transaction fees charged by the Village’s authorized third-party vendor below:

In addition to the permit fees listed in this Section, applicants are responsible for payment of all applicable transaction fees and service fees charged by the Village’s authorized third-party vendor.
