8-2-8: TRESPASS:
   A.   Violation: A person commits the offense of trespass when knowingly or intentionally:
      1.   Enters upon the land of another, including public property, when the person, prior to such entry, receives notice that such entry is forbidden; or
      2.   Remains upon the land of another, including public property, after receiving notice to depart; or
      3.   Enters upon the land of another, including public property, and remains thereon with a malicious and mischievous intent after receiving notice to depart.
   B.   Notice: A person has received notice within the meaning of subsection A of this section if the person has been notified personally, either orally by an official in the performance of his or her official duties or by an owner or occupant, or in writing, including a valid court order, or if a printed or written notice forbidding such entry has been conspicuously posted or exhibited at the main entrance to such property or the forbidden part thereof.
   C.   Exception: This section does not prohibit a person from entering upon the land of another, including public property, for emergency purposes or to a peace officer or other official of a unit of government in the performance of his or her official duties.
   D.   Definitions: For purposes of this section:
   EMERGENCY: A condition or circumstance in which an individual is or is reasonably believed by the person to be in imminent danger of serious bodily harm or in which property is or is reasonably believed to be in imminent danger of damage or destruction.
   PUBLIC PROPERTY: Property owned by the Village or the government or one of its agencies, divisions, or entities, including, but not limited to, parks, playgrounds, streets, sidewalks, schools, libraries, trails, ponds, lakes, parkways or parking areas and other property regularly used by the general public, as opposed to land held by an individual, a corporation or private entity trust for the benefit of the owners (private property).    E.   Penalty: In addition to all other remedies, every person who violates, disobeys, omits, neglects or refuses to comply with this section shall be sentenced as provided in section 1-4-1 of this Code for each offense. (Ord. 2011-29, 12-20-2011)
