7-1-3: ABATEMENT BY VILLAGE:
If any person guilty of creating, suffering or continuing any nuisance defined in this chapter shall, upon being notified as aforesaid, neglect or refuse to remove, abate or discontinue such nuisance within the time specified in such notice, it shall be the duty of the village police to cause such nuisance to be abated or removed, and he shall keep an accurate account of the necessary expense incurred thereby, which expense shall be collected from the offender by an action of debt in the name of the village, before the proper village officer, and the removal or abatement of such nuisance by the village police and the collection of the expenses thereby incurred, as herein provided, shall be no bar to the prosecution for the recovery of the penalty provided in section 7-1-2 of this chapter.
