A. There is hereby created a commission to be known as the ethics commission of the village of Minooka. The commission shall be comprised of the village president and the two (2) village trustees with the most years of service as members of the corporate authorities.
B. The commission shall have the following powers and duties:
1. Upon receipt of a signed and notarized complaint alleging a violation of this chapter by any officer or employee, to review, investigate, conduct hearings and act upon such complaints as provided in this chapter or other applicable law. The commission shall act only upon the receipt of a complaint and not upon its own prerogative.
2. To issue subpoenas and compel testimony and the production of documents and other tangible things in accordance with Illinois law. It is the obligation of all officers and employees of the village of Minooka to cooperate with the commission during the course of its investigations. Failure or refusal to cooperate with requests by the commission shall constitute grounds for discipline or discharge. When necessary or required by law, assistance may be requested from other appropriate agencies.
3. To promulgate rules for the conduct of investigatory proceedings, including procedural rules consistent with the requirements of due process of law.
4. To receive information from the public pertaining to its investigations and to require additional information and documents from persons who may have violated the provisions of this chapter.
5. The powers and duties of the commission are limited to matters clearly within the purview of this chapter. (Ord. 2004-17, 5-11-2004)
