4-5-1: MOVING BUILDINGS:
   A.   Permit Required, Fee:
      1.   It shall be unlawful to move any building in the village, not otherwise prohibited, without first obtaining a permit therefor, as provided in this section.
      2.   The fee for a permit required by this section shall be sixty dollars ($60.00). (1977 Code)
   B.   Moving Certain Buildings Prohibited: It shall be unlawful to move any building which has been damaged to any extent greater than fifty percent (50%) of its value at the time of damage by fire, action of the elements or otherwise.
   C.   Conditions Of Permit: Permits for the moving of buildings other than those prohibited in this section may be granted upon the following imposed conditions:
      1.   Written consent must be secured from a majority of the property owners located within a radius of two hundred feet (200') from the center of the lot on which the house is to be situated and such consent shall be filed with the village clerk.
      2.   Application for a permit required by this section must be made in writing, stating in detail the method of moving to be used, the exact route to be followed and the clearances necessary to traverse such route.
      3.   The written application shall be reviewed by the planning and zoning commission and forwarded to the village board of trustees for approval.
      4.   A bond shall be furnished to the village in the sum of fifty thousand dollars ($50,000.00), conditioned to indemnify the village for any liability which may be imposed upon it by reason of the moving of the building and the bond shall also be conditioned upon the faithful observance of all provisions of the building code or other ordinances of the village, and the repair of any streets or other public property damaged in the movement of any buildings.
      5.   In addition, the person requesting the permit shall furnish the village with a certificate of insurance from an insurance company licensed to do business in the state, which certificate shall name the village as coinsured. The insurance policy shall indemnify the applicant and the village against liability for the injury or death or damages in the following amounts: for the injury or death of any one person, three hundred thousand dollars ($300,000.00); for the injury or death of more than one person arising from the same accident, five hundred thousand dollars ($500,000.00); and for damages to the property of another, including the village, one hundred thousand dollars ($100,000.00).
   D.   Denial Of Permit: The building officer and inspector shall have the power to refuse to issue a permit to move any building if he shall find that the methods or equipment to be used are improper or insufficient to properly protect the public or public property from injury or damage or if the condition is such as to render it not susceptible to movement. No permit will be issued if the building is to be moved over state routes and the state has denied the applicant similar permits.
   E.   Moving Certain Small Buildings, Fees: Permits for moving buildings or parts of buildings not exceeding sixteen feet (16') in width and twelve feet (12') in height may be granted by the building officer and inspector upon the furnishing of the insurance and bond required above except that the bond shall be in the amount of fifteen thousand dollars ($15,000.00), and the payment of a permit fee of twenty three dollars fifty cents ($23.50); however, the building for which a permit is issued pursuant to this section shall be transported on a rigid, flat bodied, pneumatic tired vehicle subject to the provisions for the safeguarding of life and property as set out in this section.
   F.   Obstructing Streets:
      1.   Any obstruction or occupation of a public street, alley, sidewalk or other public property by any person operating under a permit issued pursuant to this section for a period longer than six (6) hours shall be considered an offense and each hour after the six (6) hour period shall constitute a separate offense.
      2.   A permittee under this section shall, at all times, when the building or equipment incidental to moving the building, occupies or obstructs any portion of any public street, alley, sidewalk or other public property, provide watchmen both in front and behind the obstruction and utilize all other devices necessary to completely protect the public from injury.
   G.   Planking Street: It shall be unlawful to move any building on any macadam, concrete or asphalt street or alley on hard skids, wheels or rollers unless the weight of the building and equipment combined shall be spread by the use of plank to a sufficient area on the surface of the street which, by the findings of the building inspector, is sufficient to protect the street surface from injury.
   H.   Conformity To State Laws: Nothing in this section shall be construed to alter in any way the obligation of the holder of a permit issued pursuant to this section to comply with all the restrictions and regulations which are or may be imposed by the department of highways in the state where the highways are used within the village.
   I.   Exception: Nothing in this section shall be construed as forbidding the raising or moving of a building where the process is conducted entirely within the premises of its original location. For the purposes of this section, this type of operation shall be considered as remodeling and the permit for, and the conduct of the same, shall be subject to the same regulations as any remodeling process.
