3-2-12: MOBILE FOOD VENDOR PERMITS:
   A.   Permit required. Except as otherwise provided by this article, no person shall operate a mobile food vehicle within the Village without first obtaining a permit from the Village Clerk or designee. Permits shall be issued either as (i) special event permits or (ii) annual permits.
   B.   Permit Duration; Fee.
      1.   Special event permits shall be issued in connection with a Special Event and shall be valid for the duration of such event. The fee for a special event permit shall be one hundred dollars ($100). A special event permit shall specify the dates, times, and locations for which it is valid on its face, which may differ from the dates, times, and locations otherwise permitted under this Chapter.
      2.   Annual permits shall be valid until and through the April 30th following their issuance. The fee for an annual permit shall be two hundred dollars ($200), but said fee shall be prorated based on the number of whole or partial months remaining before its expiration.
   C.   Application for Permit. The Village clerk or designee shall provide a form for application for a mobile food vehicle permit as required under this article. A mobile food vendor shall submit an application for a mobile food vehicle permit at least seven (7) days in advance of the intended date for beginning food sales upon the form provided by the Village clerk or designee and filed with such. The permit application (for both special event and annual permits) shall require the following:
      1.   The name, address and phone number of the owner and/or authorized agent of the sponsoring business;
      2.   The name, address and phone number of the mobile food vendor;
      3.   The make, model, vehicle identification number, and photograph of the mobile food vehicle;
      4.   Proof of registration and automobile insurance for the mobile food vehicle;
      5.   A general description of the types of items to be sold from the mobile food vehicle;
      6.   The specific location (common address or PIN) of the real property within the corporate boundaries of the Village where the mobile food vehicle will be operated along with a description of where the mobile food vehicle will be operated on the real property;
      7.   Written permission from the owner(s) of the property(ies) on which the mobile food truck will be operated;
      8.   The specific hours the mobile food vendor will operate the mobile food vehicle; and
      9.   Valid copies of all applicable permits from the local health departments;
      10.   A $50 non-refundable application fee.
   D.   Conditions for Approval and Operation. All mobile food vehicles must be operated in compliance with the following regulations and conditions:
      1.   Mobile food vehicles must comply with all applicable ordinances and regulations of the Village.
      2.   Mobile food vehicles must provide adequate receptacles for refuse and properly dispose of all waste.
      3.   The Mobile Food Vendor must note its point of sale as the Village of Minooka for all sales occurring within the Village’s corporate boundaries.
   E.   Issuance of Permit. If the Village Clerk determines that a mobile food vendor permit application is complete and complies with all requirements of this Chapter, the Village Clerk shall issue the permit requested, but only after the Applicant has paid the appropriate permit fee. The non-refundable application fee shall be credited against the permit fee.
   F.   Permit displayed. A copy of the approved mobile food vehicle permit shall be clearly displayed on the mobile food vehicle at all times while operating in the Village.
   G.   Written permission displayed. A copy of the written permission from the owner of the property on which the mobile food truck will be operated shall be clearly displayed on the mobile food vehicle at all times while operating in the Village. (Ord. 2023-30, 7-18-2023)
