3-2-1: DEFINITIONS:
For the purpose of this chapter, the following words as used herein shall be construed to have the meanings herein ascribed thereto:
CONVICTED: Shall mean and include a disposition of court supervision, probation, adjudication, or conditional discharge.
HAWKER: Any person who shall sell or offer for sale, barter, or exchange any goods, wares, merchandise or other commodities and cries his wares or exhibits them for sale.
ITINERANT VENDOR: Any person who transports tangible personal property for retail sale who does not maintain in an established office, distribution house, sales house, warehouse, service center or residence from which such business is conducted. However, this does not apply to any person who delivers tangible personal property who is fulfilling an order for such property which was solicited or placed by mail or other means. This does not apply to any person holding a valid license, issued by a county or municipality, to engage in retail sales.
MOBILE FOOD VEHICLE: A self-contained food service operation located in a readily moveable, motorized, wheel or towed vehicle, with facilities for storing, preparing, displaying and/or serving food or non-alcoholic beverages for retail sale intended for individual consumption, commonly referred to as a food truck.
MOBILE FOOD VENDOR: An individual, corporation, firm, partnership, association, proprietorship, not-for-profit corporation or other legal entity engaged in the business of selling food or non-alcoholic beverages from a mobile food vehicle. Mobile food vendors do not include ice cream truck operators that do not park on private property for the purpose of serving customers.
PEDDLER: Any person who shall sell or offer for sale, barter, or exchange any goods, wares, merchandise or other commodities while traveling from residence to residence on, along or upon the streets and sidewalks of the village.
REGISTERED SOLICITOR: Any person who has obtained a valid certificate of registration as hereinafter provided, and which certificate is in the possession of the solicitor on his or her person while engaged in soliciting.
RESIDENCE: Every separate living unit occupied for residential purposes by one or more persons, contained within any type of building or structure.
SOLICITING: The word "soliciting" shall mean and include any one or more of the following activities and persons:
   A.   Seeking to obtain orders for the purchase of goods, wares, merchandise, foodstuffs, services, of any kind, character or description whatever, for any kind of consideration whatever; or
   B.   Seeking to obtain prospective customers for application or purchase of insurance of any type, kind or character; or
   C.   Seeking to obtain subscriptions to books, magazines, periodicals, newspapers and every other type or kind of publications; or
   D.   Seeking to obtain gifts or contributions of money, clothing or any other valuable thing for the support or benefit of any charitable or nonprofit association, organization, corporation or project; or
   E.   Seeking to enlist support for or against a particular religion, philosophy, ideology, political party, issue or candidate, whether accepting donations of money or not, or distributing handbills or fliers advertising any event or service; or
   F.   Seeking to advertise, promote, sell and/or explain any product, service, organization or cause; or
   G.   Any person who is a hawker, peddler, transient merchant, or itinerant vendor.
   H.   Mobile food vendor, as defined in this Chapter.
SPECIAL EVENT: An event held on public or private property including but not limited to, parades, festivals, block parties, athletic events, outdoor concerts, firework displays, carnivals, movie or television productions, or other public meetings or events which significantly impact the Village or meet some or all of the following criteria:
   A.   Closure of roads, streets, or Village blocks.
   B.   Use of Village owned property.
   C.   Use of Village services.
   D.   Use of amplified sound.
TRANSIENT MERCHANT: Any person who is engaged temporarily in the retail sale of goods, wares or merchandise and who, for the purpose of conducting such business, occupies any building, room, vehicle, structure of any kind, or vacant lot. However, this does not apply to any person selling goods, wares or merchandise which are raised, produced or manufactured by him, to any person selling vegetables, fruit or perishable farm products at an established city or village market, to any person operating a store or refreshment stand at a resort, to any person operating a stand or booth on or adjacent to property owned by him or upon which he resides, to any person operating a stand or booth at a state or county fair, or to any person operating a stand or booth at a trade show, exposition, convention or similar event.
