§ 76.01 DEFINITIONS.
   When used in this chapter, the following words, terms and phrases shall have the meanings ascribed to them in this section except where the context clearly indicates a different meaning:
   ABANDONED VEHICLE. Is a vehicle that:
      (1)   Is left upon a public street or highway in violation of a law or ordinance prohibiting parking;
      (2)   Is left on a public street or highway for longer than seven days or is determined by law enforcement to be a hazard to the motoring public;
      (3)   Is left on property owned or operated by the town for longer than 24 hours; or
      (4)   Is left on private property without the consent of the owner, occupant or lessee of such property for longer than two hours.
   AUTHORIZING OFFICIAL(S). The Mayor is designated to authorize the removal of vehicles under the provisions of this chapter. Such authority may be delegated by the Mayor to any town official or employee at his/her sole discretion.
   CODE ENFORCEMENT OFFICER. The town employee(s) or agent(s) designated by the Mayor to enforce the provisions of this chapter.
   JUNKED MOTOR VEHICLE. A vehicle that does not display a current license plate and is either:
      (1)   Partially dismantled or wrecked;
      (2)   Cannot be self-propelled or moved in the way it was originally intended to move; or
      (3)   More than five years old and appears to be worth less than $500.
   MOTOR VEHICLE or VEHICLE. All machines designed or intended to travel over land or water, including watercraft, by self-propulsion or while attached to any self-propelled vehicle.
   NUISANCE VEHICLE. A vehicle on public or private property that is determined and declared by the code enforcement officer to be a health or safety hazard to neighboring residents or businesses or to the public, including but not limited to a vehicle found to:
      (1)   Be a point of concentration of gasoline, oil or other flammable or explosive materials;
      (2)   Have accessible areas of confinement that cannot be opened from the inside, such as trunks, hoods, etc.;
      (3)   Be in danger of falling or turning over;
      (4)   Be a point of collection of garbage, food waste, animal waste, or any other rotten or putrescible matter of any kind;
      (5)   Have exposed sharp parts or edges of metal or glass;
      (6)   A breeding ground or harbor for mosquitoes, other insects, rats or other pests;
      (7)   A point of heavy growth of weeds or other noxious vegetation over eight inches in height;
      (8)   A point of collection of pools or ponds of water; or
      (9)   Otherwise pose a health and safety hazard as determined by authorizing official(s) or any duly designated code enforcement officer based on the following:
         (a)   Danger posed to licensees, invitees, or trespassers of the property owner;
         (b)   Danger posed to pedestrians or vehicular traffic;
         (c)   Tendency to cause onlooker distraction of passing motor vehicles;
         (d)   Environmental concerns; or
         (e)   Concerns regarding disruption of stormwater drainage.
   WATERCRAFT. Any boat, vessel, craft, or other conveyance that is designed to be used, or is made to use, for the transportation of persons, goods, or a combination thereof upon or under the water; except that inflatable pool rafts, un-motorized water skis, and other similar small devices are excluded.
