A. Requests For Data; Costs And Agreement: All requests for GIS data shall be submitted to Minidoka County and shall be subject to fees as adopted by resolution by the Minidoka County board of county commissioners. Such requests are further subject to a "computerized mapping data products license agreement" (hereinafter referred to as "license agreement") to be executed in each instance in a form substantially similar to exhibit A attached to the ordinance codified herein in the office of the Minidoka County clerk. The Minidoka County assessor is hereby authorized to accept and fulfill such license agreements on behalf of Minidoka County.
B. Exemption From Costs: Persons, organizations or agencies may request to be exempt from the required fees to acquire Minidoka County's GIS data by submitting said proposal in writing to the Minidoka County assessor, who shall forward a recommendation to the board of county commissioners. This may be approved if the board has determined the following:
1. Minidoka County will receive GIS data from the requester, or services related to the same, that is of comparable or equal value to that which is to be provided by the county.
2. The requester ensures that the data will be protected from improper or illegal use.
3. The benefits to the county and the public outweigh the revenue loss from the fee waiver. (Ord. 2016-02-01, 2-1-2016)
