(a) “Protective Bicycle Helmet” means a piece of headgear which meets or exceeds the impact standards for protective bicycle helmets set by the American National Standards Institute (ANSI) or the Snell Memorial foundation’s standards for protective headgear or American Society for Testing and Materials (ASTM) used in bicycling.
(b) No person thirteen years of age or under shall operate or be a passenger on a bicycle or any attachment to a bicycle used on a public roadway, public bicycle path or other public right-of-way unless at all times when a person is so engaged he or she wears a protective bicycle helmet of good fit, fastened securely upon the head with the straps of the helmet.
(c) No parent or legal guardian of a person thirteen years of age or under shall knowingly permit such person to operate or be a passenger on a bicycle or any attachment to a bicycle used on a public roadway, public bicycle path or other public right-of-way unless at all times when a person is so engaged he or she wears a protective bicycle helmet of good fit, fastened securely upon the head with the straps of the helmet.
(d) (1) Whoever violates any provision of this ordinance shall be subject of a fine not to exceed twenty-five dollars ($25.00). The court may waive any or all of the fine upon satisfactory proof that the person has a helmet or has obtained a helmet within a reasonable time after said violation. The court shall impose no fine if a parent or guardian is unable to pay for said helmet and has filed a financial affidavit to that effect with the court.
(2) Whoever is convicted of violating any provision of this section on more than one occasion is guilty of a minor misdemeanor.
