1333.02  AMENDMENTS.
   The following sections of the International Property Maintenance Code are hereby revised:
   
Section 101.1.  These regulations shall be known as the Property Maintenance Code of the Village of Mingo Junction, Ohio, hereinafter referred to as “this code”.
Section 103.5.  No fees shall be assessed at this time for activities and services performed by the department in carrying out its responsibilities under this code.
Section 106.4.  Any person or entity who shall violate a provision of this code, or fail to comply therewith, or with any of the requirements thereof, shall be prosecuted within the limits provided by state or local laws.  The penalty for a violation of this code shall be a fine of not more than one hundred dollars ($100.00).  Each day that a violation continues after the required notices have been served shall be deemed a separate offense. 
Section 111.2.  The board of appeals as established by the International Property Maintenance Code shall consist of three (3) voting members and two (2) alternatives.  The requirements for membership set forth in this code shall be complied with as nearly as is practicable and all members shall be residents of the Village of Mingo Junction, Ohio.

Section 302.8.1. Boats and Recreational Vehicles. 
   (A)   Except as provided in other regulations not more than two recreational boats with or without a trailer, non-commercial trailer, or other recreational vehicle shall be parked, kept or stored on any exterior area residential area.
   (B)   Said boats and vehicles shall be parked only in the rear or side yard of said property and shall be at least five (5) feet from any property line.
   (C)   No such boat or vehicle shall be in a state of disassembly, disrepair, in the process of being stripped or dismantled, or otherwise be inoperable.  Each said boat or vehicle shall have a current valid registration as required for its use.
   (D)   Said boats or vehicles shall be secured in a manner so as not to pose a threat of moving, coasting or otherwise pose a threat to the public safety and welfare.
   (E)   Said boats or vehicles shall at no time be parked, kept or stored on any street, alley, or public way.  There be and hereby is established the following positions in the Village Police Department.

Section 302.4.  All premises and exterior property shall be maintained free from weeds or plant growth in excess of ten inches (10").  All noxious weeds shall be prohibited.  Weeds shall be defined as all grasses, annual plants and vegetation, other than trees or shrubs provided; however, this term shall not include cultivated flowers and gardens.
Upon failure of the owner or agent having charge of a property to cut and destroy weeds after service of a notice violation, they shall be subject to prosecution in accordance with Section 106.3 and as prescribed by the authority having jurisdiction.  Upon failure to comply with the notice of violation, any duly authorized employee of the jurisdiction or contractor hire by the jurisdiction shall be authorized to enter upon the property in violation and cut and destroy the weeds growing thereon, and the costs of such removal shall be paid by the owner or agent responsible for the property.
Section 304.14.  Insect screens.  During the period from April 1st to October 1st of each calendar year, every door, window and other outside opening required for ventilation of habitable rooms, food preparation areas, food service areas or any areas where products to be included or utilized in food for human consumption are processed, manufactured, packaged or stored, shall be supplied with approved tightly fitting screens of not less than 16 mesh per inch (16 mesh per 25mm) and every screen door used for insect control shall have a self-closing device in good working condition.
Section 602.3.  Heat supply.  Every owner or operator of any building who rents, leases or lets one or more dwelling unit, or sleeping units, either expressed or implied, to furnish heat to the occupants thereof shall supply heat during the period from October 1st to April 1st of each calendar year to maintain a temperature of not less than 68 degrees Fahrenheit (20 degrees Celsius) in all habitable rooms, bathrooms and toilet rooms.
Exceptions. 
1.   When the outdoor temperature is below the winter outdoor design temperature for the locality, maintenance of the minimum room temperature shall not be required provided that the heating system is operating at its full design capacity.  The winter outdoor design temperature for the locality shall be as indicated in Appendix D of the “International Plumbing Code.”
      2.   In areas where the average monthly temperature is above 30 degrees Fahrenheit (-1 C) a minimum temperature of 65 degrees Fahrenheit (18 C) shall be maintained.
Section 602.4. Occupiable work spaces.  Indoor occupiable work spaces shall be supplied with heat during the period from October 1st to April 1st of each calendar year to maintain a temperature of not less than 65 degrees Fahrenheit (18 degrees Celsius) during the period the spaces are occupied.
Exceptions.
      1.   Processing, storage and operation areas that require cooling or special temperature conditions.
      2.   Area in which persons are primarily engaged in vigorous physical activities.
