As used in this chapter:
(a) "Billing charges" means the charges resulting from the administrative expenses associated with the billing procedure.
(b) "BOD" (denoting Biochemical Oxygen Demand) means the quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five days at 20°C. expressed in milligrams per liter.
(c) "Building drain" means that part of the lowest horizontal piping of a drainage system which receives the discharge from soil waste and other drainage pipes inside the walls of a building and conveys it to the building sewer beginning three feet outside the building wall.
(d) "Building sewer" means the extension from the building drain to the public sewer or other place of disposal.
(e) "COD" (Chemical Oxygen Demand) means the quantity of oxygen required to satisfy the carbon in a waste as determined by chemical oxidation of the waste with a strong oxidation agent-acid solution.
(f) "Combined sewer" means a sewer intended to receive both wastewater and storm or surface water.
(g) "Commercial user" means any retail or wholesale business establishment. It also means any service organization public or government building.
(h) "Control authority" refers to the duly authorized representative of the Village.
(i) "Debt service charge" means the charges resulting from the capital investment in wastewater systems consisting of annual principal and interest payments and other amounts required in connection with the issuance and sale of bonds to provide the funds for construction.
(j) "Domestic sewage" or "normal sewage" means the sewage derived principally from dwellings, business buildings, institutions, and the like which originates within the building, including the waste from kitchens, water closets, lavatories, bathrooms, showers and laundries. It also means sewage which, when analyzed, shows by weight a daily average not more than 280 parts per million of suspended solids, nor more than 240 parts per million of BOD and/or 500 parts per million of COD, nor more than 8 parts per million phosphorus.
(k) "Foundation drains" means subsurface drains laid around the foundation of a building either within or outside of the building foundation for the purpose of carrying ground or subsurface water to some point of disposal.
(l) "Garbage" means solid wastes from the domestic and commercial preparation, cooking, and dispensing of food; or from the commercial handling, storage or sale of produce.
(m) "Industrial user" means any user engaged in manufacturing activities involving the mechanical or chemical transformation of materials into other products.
(n) "Industrial waste" means the liquid and water-carried wastes resulting from the processes employed in industrial, manufacturing, trade, or business establishments as distinct from domestic wastes.
(o) "Interference" means the inhibition or disruption of the POTW treatment processes or operations or which contributes to a violation of any requirement of the Village’s NPDES Permit. The term includes prevention of sewage sludge use or disposal by the POTW in accordance with 405 of the Act. (33 U.S.C. 1345) or any criteria, guidelines or regulations developed pursuant to the Solid Waste Disposal Act (SWDA), the Clean Air Act, the Toxic Substances Control Act, or more stringent State criteria (including those contained in any State sludge management plan prepared pursuant to Title IV of SWDA) applicable to the method of disposal or use employed by the POTW.
(p) "Maintenance" means upkeep and repair costs required to maintain the wastewater treatment works structures and equipment in efficient operating condition during the service life of such works.
(q) "Major industrial user" means a user that will contribute greater than ten percent (10%) of the design flow or design pollutant loading of the treatment works.
(r) "Minor industrial user" means a user that will contribute greater than five percent (5%) of the design flow or design pollutant loading of the treatment works.
(s) "National Categorical Pretreatment Standard" or "Pretreatment Standard" means any regulation containing pollutant discharge limits promulgated by the EPA in accordance with Section 307(b) and (c) of the Act (33 U.S.C. 1347) which applies to a specific category of industrial user.
(t) "National Pollutant Discharge Elimination System (NPDES) Permit" means any permit or equivalent document or requirements issued by the State water pollution control agency to regulate the discharge of pollutants from the wastewater treatment works.
(u) "National Prohibitive Discharge Standard"or"Prohibitive Discharge Standard" means any regulation developed under the authority of 307(b) of the Act and 40 CFR, Section 403.5.
(v) "Natural outlet" means any outlet into a watercourse, pond, ditch, lake or other body of surface or groundwater.
(w) "New source" means any source, the construction of which is commenced after publication of proposed regulations prescribing a Section 307(c) (33 U.S.C. 1317) categorical pretreatment standard which will be applicable to such source, if such standard is thereafter promulgated within 120 days of proposal in the Federal Register. Where the standard is promulgated later than 120 days after proposal, a new source means any source, the construction of which is commenced after the date of promulgation of the standard.
(x) "Non-industrial user" means a user of the wastewater treatment works not in the "industrial user” classification, as defined herein.
(y) "Normal sewage" or "residential sewage" means sewage derived principally from dwellings, business buildings, institutions, and the like which originates within the building, including the waste from kitchens, water closets, lavatories, bathrooms, showers and laundries. It shall also mean sewage which, when analyzed, shows by weight a daily average not more than 280 parts per million of suspended solids, nor more than 240 parts per million of BOD and/or 500 parts per million of COD, nor more than 8 parts per million phosphorus. These concentrations will be used for determining surcharges.
(z) "Ohio Environmental Protection Agency (OEPA)" means the department of the State of Ohio assigned and designated as the legal authority of administration, supervision, and regulation of wastewater (municipal, private, and industrial) treatment plants in Ohio, under amended State Bill 397, and any subsequent amendments.
(aa) "O M & R cost" means the operation, maintenance and replacement cost to efficiently operate and maintain the Village’s wastewater works as defined in this chapter.
(bb) "Operation" means any physical and mechanical actions, processes or functions required to efficiently operate the wastewater treatment works as defined herein.
(cc) "Person, enterprise, establishment, or owner" means any individual, partnership, firm, company, association, society, corporation, or any other entity using the Sewage Works or Sewerage System.
(dd) "pH" means the logarithm of the reciprocal of the weight of hydrogen ions in grams per liter of solution.
(ee) "Phosphorus" means a constituent in wastewater as identified in "Standard Methods for the Examination of Water and Wastewater.”
(ff) "Pollutant" means any dredged spoil, solid waste, incinerator residue, sewage, garbage, sewage sludge, munitions, chemical wastes, biological materials, radioactive materials, heat wrecked or discharged equipment, rock, sand, cellar dirt and industrial, municipal and agricultural waste discharged into water.
(gg) "Pollution" means the man-made or man-induced alteration of the chemical, physical, biological, and radiological integrity of water.
(hh) "POTW" (Publicly Owned Treatment Works) or (Treatment Works) means a treatment works as defined by Section 212 of the Act (33 U.S.C. 1292) which is owned in this instance by the Village. This definition includes any sewers that convey wastewater to the POTW treatment plant, but does not include pipes, sewers or other conveyances not connected to a facility providing treatment. For the purposes of this chapter, "POTW" also includes any sewers that convey wastewater to the POTW from persons outside the Village who are, by contract or agreement with the Village, users of the Village POTW.
(ii) "POTW Treatment Plant" means that portion of the POTW designed to provide treatment of wastewater.
(jj) "Pretreatment" or "treatment" means the reduction of the amount of pollutants, the elimination of pollutants, or the alteration of the nature of pollutant properties in wastewater to a less harmful state prior to or in lieu of discharging or otherwise introducing such pollutants into a POTW. The reduction or alteration can be obtained by physical, chemical or biological processes, by process changes or other means, except as prohibited by 40 CFR Section 403.6(d).
(kk) "Public sewer" means a sewer in which all owners of abutting properties have equal rights and is controlled by public authority.
(ll) "Replacement" means expenditures for obtaining and installing equipment, accessories or appurtenances necessary to retain design capacity and performance of the wastewater treatment works throughout the Village’s jurisdiction.
(mm) "Residential user" means any family residence or habitation classified as single or multi-family dwelling.
(nn) "Sanitary sewer" means a sewer which carries sewage and industrial waste and to which storm, surface, or groundwaters are not intentionally admitted.
(oo) “Sewage" means a combination of the liquid and water-carried wastes from residences, commercial buildings, institutions and industrial establishments (including polluted cooling water).
(pp) "Sewage surcharge" or "extra strength surcharge" means the fee required to maintain sewers and to cover the increased cost of treating "Industrial Wastes" in addition to the cost of treating "Normal Sewage" in the City, at a rate passed by Council or ordinance.
(qq) "Sewage Treatment Plant", "Wastewater Treatment Plant", or "Water Pollution Control Plant" means any arrangement of devices and structures used for treating sewage.
(rr) "Sewage Works Wastewater Treatment Works" or "Sewerage System" means all facilities for collecting, pumping, treating, or disposing of sewage.
(ss) "Sewer" means a pipe or conduit for carrying sewage.
(tt) "Sewer Service Charge" or "Sewer Service Rate" means the fee required to maintain sewers and to cover the cost of treating "Normal Sewage" in the Village at a rate passed by Council in ordinance. This charge shall be the sum of the user charge for OM & R and the debt service charge, including administrative charges.
(uu) "Shall" is mandatory; "May" is permissive.
(vv) "Significant Industrial User" means a user that will contribute greater than ten percent (10%) of the design flow or design pollutant loading of the treatment works.
(ww) "Slug" means any substance released in a discharge at a rate and/or concentration which causes interference to a POTW.
(xx) "Standard Industrial Classification" (SIC) means a classification pursuant to the Standard Industrial Classification Manual issued by the Executive Office of the President, Office of Management and Budget, 1972.
(yy) "Standard Methods" means the laboratory procedures set forth in the latest edition, at the time of analysis, of "Standard Methods for the Examination of Water and Wastewater" prepared and published jointly by the American Public Health Association, the American Water Works Association, and the Water Pollution Control Federation.
(zz) "Storm sewer" or "storm drain" means a pipe or conduit which carries storm and/or surface waters and/or drainage, but excludes sewage and/or industrial wastes; it may, however, carry cooling water and/or unpolluted waters.
(aaa) "Storm water" means any flow occurring during or following any form of natural precipitation and resulting therefrom.
(bbb) "Suspended solids" means solids that either float on the surface of, or are in suspension in water, sewage, or other liquids, and which are removable by laboratory filtering.
(ccc) "Toxic pollutant" means any pollutant or combination of pollutants listed as toxic in regulations promulgated by the Administrator of the Environmental Protection Agency under the provision of CWA 307(a) or other Acts.
(ddd) "User" means any person who contributes, causes or permits the contribution of wastewater into the Village’s POTW.
(eee) "User charge" means a charge levied on users of the wastewater treatment works for the operation, maintenance and replacement costs of such works.
(fff) "Wastewater" means the liquid and water-carried waste from dwellings, commercial buildings, industrial facilities, and institutions, together with any groundwater, surface water, or storm water that may be present, whether treated or untreated which is discharged or permitted to enter the wastewater treatment system.
(ggg) "Wastewater Treatment System" means the structures, equipment, and process required to collect, transport, and treat domestic and industrial wastes and dispose of the effluent and accumulated residual solids and shall be synonymous with "sewage system."
