§ 248.11 EMPLOYEE ASSISTANCE.
   (a)   The village may offer assistance to employees with a substance use problem who voluntarily take action to address a substance problem, and the village may provide these employees a second chance, if the employee is willing to actively engage in treatment to resolve the substance use problem. The village will refer the employee to a treatment provider for an assessment and possible outpatient counseling.
   (b)   Employees who violate this Policy or fail to meet with a treatment provider, attend treatment sessions or actively participate in said treatment will not receive a “second chance.” However, an employee who completes an approved course of treatment may be allowed to return to work subject to signing a “second chance” or “last chance” agreement acknowledging that a second violation of the Policy will result in termination of employment and provided the village still has a position available for which the employee is qualified to perform the essential functions of the job, with or without reasonable accommodation. The village will test the employee prior to returning the employee to work, and at various times thereafter in conformance with this policy. All subsequent tests must be negative.
