§ 10-202  ADMINISTRATION.
   The President of Council of the Borough of Minersville shall collect all fees as follows:
      A.   Fees and costs to be collected include applicable overhead costs and all personnel, equipment, materials and maintenance expenses in such a form as to ensure full reimbursement for charges for services actually rendered and materials provided by all public, volunteer and private sectors. A particular cost or fee schedule is not set forth in this Section or elsewhere in the Borough ordinance or by further formal action by Borough Council. Rather, the Borough’s approval of this Section shall constitute authorization for the President to collect all such fees and costs, including overhead costs, upon receipt of expenditure or cost statements submitted to the Borough by affected public and private bureaus, agencies, departments, companies or entities, or volunteer organizations.
      B.   Within 30 days of the date of the extraordinary or dangerous occurrence giving rise to the extraordinary expense or service, the affected public, volunteer or private entity shall submit its related costs, fees, charges and expenses to the President of Council for review. At such time as all costs, fees, charges and expenses related to the incident have been collected and reviewed, but in any case not later than 60 days from the date of determining the combined cost of rendering extraordinary services, the President shall submit a bill for all costs, fees, charges and expenses to the owner, agent or manager of the vehicle, fixed facility, of other instrumentality, which caused the need for extraordinary expense and services, with a demand that a full remittance be made within 30 days of receipt.
      C.   In cases of hardship, or where circumstances are such that a full remittance cannot be made to the Borough within the 30-day period, the Borough hereby authorizes the Borough Solicitor to enter into negotiations with the party or entity owing the expense for payments to be made over a period of time not to exceed six months from the date of the incident for which the costs and the like were incurred.
      D.   All moneys received under the provisions of this Part shall be placed into the General Fund and reimbursement made to all public, volunteer and private entities which had submitted the extraordinary expenses and services statements as outlined herein. In the event full payment is not received, the reimbursement of all public sector departments or agencies shall be made in full first, then reimbursement shall be made to all volunteer agencies before payment is made to the private sector. In the event full payment is not received for any class which incurred costs for expense or service (public, volunteer or private), the funds shall be distributed to the members of the class proportionately according to the percentage of the expense incurred by each member is to the total expense of the class.
