§ 50.02 BURNING OF GARBAGE.
   (A)   It shall be unlawful to burn papers, excelsior, or any other flammable material, which may be blown about by the wind, anywhere in the village, unless the same is burned in a stove, fireplace or furnace, or in an incinerator sufficiently fine to prevent the escape of ignited particles.
   (B)   It shall be unlawful to burn any garbage or other organic refuse outside of any building at any time.
   (C)   It shall be unlawful to light or maintain any outside fire at any time except between the hours of sunrise and sunset.
   (D)   It shall be unlawful to build or maintain any outside fire within three feet of a property line or within 12 feet of any combustible materials.
   (E)   All outside burning as described in this section shall be constantly attended by a competent person until such fire is extinguished; and such person shall have an operable hose connected to the water supply or other fire extinguishing equipment readily available for use if necessary.
   (F)   The Chief of the Fire Department may prohibit any outside fires when atmospheric conditions or local circumstances make such fire hazardous.
   (G)   The burning of leaves and other yard waste by the owner or occupant of premises within the village is hereby permitted on the days and during the hours herein specified if such leaves and yard waste have been raked and piled and all other conditions and requirements of this section have been met. The specific days and hours for such burning are Wednesdays from 11:00 a.m. until 7:00 p.m. and Saturdays from 9:00 a.m. until 4:00 p.m., except that during the months of November, December, January, February and March no burning shall be permitted on Wednesdays after sunset. No burning shall be allowed on any public street, surface, public easement, or within any open storm water ditch within the public right-of-way.
   (H)   Any person aggrieved by this section may apply to the Chief of the Fire Department for relief; and, after investigation, the Fire Chief may grant a variance where a literal enforcement of this section would result in exceptional difficulties or unusual hardships, so that substantial justice will be done and the public safety and welfare secured.
