§ 31.50 VILLAGE ATTORNEY.
   (A)   It shall be the duty of the Village Attorney to prosecute and defend all suits and actions before any court of the county or before any board, authority, commission or agency of the county, to which the village is a party, or in which, in the opinion of the Board of Trustees, the interests of the village are in any wise affected, or in which the official acts of any of the officers or employees of the village are involved.
   (B)   The Village Attorney shall also advise the Board of Trustees and the officers of the village on such legal questions as may arise in relation to the business of the village.
   (C)   The Village Attorney shall prepare all ordinances, resolutions or motions that may be requested of him or her by any Trustee.
   (D)   The Village Attorney shall annually render a report on any litigation or proceeding that may have been pending during the preceding year, so that the Board of Trustees may be advised therein.
   (E)   The Village Attorney shall have the authority to dismiss any suit in which the village is plaintiff or prosecution, in which in his or her opinion, the necessary proof cannot be made.
