§ 92.18 DISINTERMENTS AND REMOVALS.
   (A)   Disinterment shall be the removal of a body and its containing vessel from the place of interment, regardless of the reason therefor.
   (B)   Priorities among the next of kin as hereinafter mentioned shall be as follows:
      (1)   The surviving spouse, if any;
      (2)   Children;
      (3)   Parents;
      (4)   Grandchildren;
      (5)   Brothers and sisters;
      (6)   Grandparents;
      (7)   Collaterals.
   (C)   Prior to the disinterment of any body, the next of kin of the class as entitled to priority, shall unanimously make application so to do by filling out a form to be furnished for that purpose by the village. The application shall identify the deceased, indicate the next of kin making the application, and disclose the name of the person engaged to do the disinterring of the containing vessel. If the decedent is buried on a lot or grave space, the title to which shall not be in his or her name exclusively, the application shall also be signed by the surviving lot owners or the surviving next of kin of the other lot owners in the same priority of class.
   (D)   The village shall remove the ground down to the top of the containing vessel or vault, if there be one, and shall refill the grave except for the ground removed by the person disinterring the containing vessel, which ground shall be refilled by him or her.
   (E)   The village shall be notified at least two days prior to the day on which it is desired to have the disinterment made.
   (F)   (1)   Disinterment will not be permitted on any of the following days:
         (a)   For three days prior to and including Mother’s Day, Father’s Day, New Years, Memorial Day, Independence Day, Labor Day, Thanksgiving and Christmas days;
         (b)   On Saturdays or Sundays;
         (c)   On days on which funerals are scheduled in the cemetery;
      (2)   At such time of the year when freezing or thawing shall place the surface of the cemetery in a condition soft enough that the wheels of the vehicle used in the disinterment shall depress the ground surface more than two inches.
   (G)   Disinterment must be completed by 3:30 p.m. on the day on which disinterment is to be made.
   (H)   The necessary permit required by law must be secured by the applicant and must be presented to the village prior to the disinterment.
   (I)   The person designated for the removal of the containing vessel shall not use any mechanical equipment in excavation and shall use only such equipment for lifting the containing vessel which is similar to that equipment normally used for the original placing of it. All ground removed by the person or firm removing the containing vessel shall be deposited on cover, tarpaulin or plywood, and be replaced without spillage on other graves or ground surface.
   (J)   The fees for disinterment and removal shall be the same as stated for grave openings.
