(A) The town my extinguish any fire that is in violation of this subchapter and charge the party responsible $250 for each such extinguishment.
(B) Subchapter violations shall be enforced under proceedings brought pursuant to I.C. 34-28-5-1 et seq. in a manner similar to that of infractions with complaint and summons described in I.C. 9-30-3-6 issued by the town’s Police Department or any other police agency.
(C) The Town Council gives authority to the town’s Police Department, Clinton Township Fire Department, Benton Township Fire Department, and/or any other police or fire department to enter upon any property in violation of this subchapter in order to extinguish any and all fire, smoke, or kindling in violation of this subchapter.
(D) The provisions of this subchapter shall be interpreted so as to be valid and enforceable and consistent with, but more restrictive than, 326 I.A.C. 4-1-1.
