921.03 REIMBURSEMENT TO DEVELOPER FOR WATER AND SEWER LINES.
   (a)   The purpose of this section is to provide a developer a means to recoup all or part of the costs relating to the construction of water, or sanitary sewer lines within the Village. This recoupment is not available for developers required to make installations at their expense by order of the Planning Commission under and by virtue of the Subdivision Regulations.
   (b)    For purposes of this section, a "developer" is defined as an owner or other person who has constructed a water or sanitary sewer line by the authority of and under the direction of the Village.
   (c)   Whenever a water or sewer line is constructed by a developer, except in cases where the developer is required to make installations at their expense by order of the Planning Commission under and by virtue of the Subdivision Regulations, such developer shall certify the cost of the improvement to the Village Administrator immediately upon completion. The amount shall be subject to the approval of the Village Administrator and may be reduced if the Village Administrator, after consultation with an engineer as necessary, and in the Administrator's unqualified discretion, believes that the cost is excessive.
   (d)   The owner of any abutting property to be serviced by the line, and for which property the cost thereof has not been paid, shall pay his pro-rata share of the cost of the line as determined by the Village Administrator before tapping into it.
   (e)   The money so received shall be paid to the developer or his heirs, executors, administrators or assigns. However, no such payment to such developer shall be made more than ten years after completion of the construction and certification of the cost to the Village Administrator. Any tap fees received after ten years shall be a part of the sewer or water fund, whichever the case may be.
   (f)   At no time can the developer recoup an amount greater than the cost certified by the Village Administrator.
   (g)   The pro-rata share shall be determined as follows:
      (1)    Sewer Recoupment Formula
Additional Sewer Tap Fee = Sanitary Sewer Cost X Customer Flow ÷ (.3 X Design Flow)
   Where:   Customer Flow = Customer Flow determined from EPA Suggested Sewage Flow Guide
               Design Flow = Capacity of sewer when flowing full

   Additional Water Tap Fee = Water Line Cost X Customer Flow ÷ (.3 X Design Flow)

If a hearing is requested before the scheduled date for termination, termination will not take place until the hearing process is complete. If you request a hearing, you have the right to examine water/sewer department records concerning this service address; to bring a representative to help you at the hearing; and to bring witnesses to testify on your behalf;
(3)   OR, if you are a tenant, and if in your rental agreement, the landlord is responsible for paying the water/sewer and sewer bill, you may be able to avoid termination by paying: (l)the water/sewer and sewer charge for usage from the last meter reading to date, (2) the past due delinquent amount.
If you wish to avoid termination, or to request a hearing, or wish a more complete explanation of your hearing rights or your rights to assume responsibility for future water/sewer charges, you should immediately contact Marty Grice at the Water/Sewer Department at the address and telephone number listed in this letter between the hours of 8:00 AM and 4:30 PM, Monday through Friday.
