135.04 PAYMENT OF ATTORNEY’S FEES FOR INDIGENT DEFENDANTS.

The Clerk-Treasurer of the Village is hereby authorized to pay attorney’s fees, upon proper application by the attorney, along with an affidavit of indigency of the defendant. The hourly rate of said fees shall be the same as established in the County Court of Holmes County, State of Ohio, for Court-appointed representation. The determination of indigency shall be made by the Judge of the County Court of Holmes County, Ohio. This section shall be deemed to be retroactive as of May 1, 1989, and shall provide for all fees submitted on and after May 1, 1989.
