1349.16 DESIGNATION PROCEDURES FOR DESIGN DISTRICTS OR HISTORIC LANDMARKS.
   (a)   When a proposal to establish a design district or to designate an individual property or site as a landmark for protection is received by or initiated by the DRB, the owner or owners shall be notified.
   (b)   The DRB shall consider the proposal in terms of the criteria provided in Section 1349.15 and make a recommendation to Village Council.
   (c)   Village Council shall cause an appropriate ordinance to be prepared, shall schedule a public hearing on the proposed legislation, setting forth a date, time and place, and shall cause written notice to be given to the owner or any person having a legal or equitable interest in the property being proposed for designation.
   (d)   Village Council shall give due consideration to the findings and recommendations of the DRB, the owner’s written comments and to the public hearing comments in making its determination with respect to the proposed designation of an area, place, building, structure, work of art or similar object as a historic district or landmark.
   (e)   After a decision by the Village Council, the Clerk of Council shall notify all persons known to have a legal or equitable interest in said property, as well as the DRB.
   (f)   The DRB shall notify any appropriate county or state offices after a designation is approved.
   (g)   Minutes of the actions taken during the meetings will be kept and shall be available for public inspection. (Ord. 2010-101. Passed 4-26-10.)
