957.03 CABLE COMMISSION.
   (a)   Members There is hereby created a Cable Commission of the Village which shall consist of five (5) members appointed by Village Council for terms of four (4) years. The initial terms shall be as follows: one (1) member for a term of one (1) year; one (1) member for a term of two (2) years; one (1) member for a term of three (3) years; and two (2) members for terms of four (4) years. All subsequent appointments shall be for terms of four (4) years. All members of the Commission shall be residents of the Village. The Cable Commission shall have a Secretary designated by the Mayor. A member of the Village Law Department shall be in attendance at Cable Commission meetings when determined to be necessary by the Mayor.
   (b)   Duties and Responsibilities. The Cable Commission shall have the following duties and responsibilities for cable customer service:
      (1)   The Commission shall hear Complaints of Subscribers and endeavor to informally resolve all such Complaints. In the event the Commission is unable to informally resolve any Complaint, the Commission shall hold a hearing on the Complaint with at least ten (10) days written notice to the Cable Operator and the complainant. After the hearing, the Commission shall make written findings and conclusions and issue a written order, which may assess a penalty if appropriate as provided in Section 957.04(g). All formal decisions of the Commission shall be subject to review by Village Council, which may act to affirm, overrule or modify the decision of the Commission or any aspect of the decision within thirty (30) days of announcement of the decision. In the event Village Council takes no action within such thirty (30) day period, the decision of the Commission shall be deemed final.
      (2)   The Commission shall oversee the Cable Operator’s customer service practices in the Village, and shall recommend to Village Council any amendments to the customer service standards in this Chapter it deems to be in the Village’s best interests in accordance with Federal and state law.
   (c)   Meetings The Cable Commission shall establish a schedule of regular meetings and shall meet at such regularly scheduled meetings at least four (4) times per year. The Commission may hold special meetings to review particular complaints or rate change requests or other matters. Notice of special meetings shall comply with the Village’s general notice requirements for special meetings of its boards and commissions and shall include written notice to all Cable Operators. The Commission, with the assistance of the law department, may establish its own rules to govern the conduct of its meetings.
