(a) The establishment of a sexually oriented business shall be permitted only in specified B-3 zones, and shall be subject to the following restrictions:
(1) No person shall cause or permit the establishment (defined as the opening of a new business, relocation of an existing business or the conversion of an existing business) of a sexually oriented business unless authorized by the issuance of a permit in accordance with Secs. 1157.02(h), (j), (m), (n), (o) and/or (p), as applicable, of the Milford Zoning Code.
(2) Sexually oriented businesses, as defined above, shall be permitted only in B-3 designated zones and shall comply with all generally applicable regulations within such zone.
(3) No sexually oriented business shall be located within 250 feet of any religious institution, school, boys or girls club, or similar existing youth organization, public park, public building or any property zoned for residential use or used for residential purposes.
(4) No sexually oriented business shall be located within 750 feet of another sexually oriented business.
(b) A person commits a misdemeanor if he operates or causes to be operated a sexually oriented business in violation of this section. (Ord. 01-92. Passed 2-6-01.)
