925.99 PENALTY.
   (a)   General Penalty. Whoever violates any provision of this chapter, where another penalty is not otherwise provided, shall be fined not less than five hundred dollars ($500.00) nor more than five thousand dollars ($5,000) for each violation. Each day in which any such violation shall continue shall be deemed a separate offense.
   (b)   Falsification or Tampering. Any person who knowingly makes any false statement, representation or certification in any application, record, report, plan or other document filed or required to be maintained pursuant to this chapter or who falsifies, tampers with or knowingly renders inaccurate any monitoring device or method required under this chapter shall be fined not less than five hundred dollars ($500.00) or more than five thousand dollars ($5,000) for each violation. Each day in which any such violation shall continue shall be deemed a separate offense.

   (c)   Liability for Loss or Damage. Whoever violates any provisions of this chapter shall become liable to the City for any expense, loss or damage occasioned the City by reason of such violation including those costs assessed by the Ohio Environmental Protection Agency and/or the U.S. Environmental Protection Agency as a result of the wastewater treatment plant's inability to treat and effectively reduce the pollutant.
   (d)   Discharge of Hazardous Substances. Whoever violates Section 925.04  is guilty of a misdemeanor of the first degree and shall be punished as provided in Section 501.99 of the Codified Ordinances.
 
   (e)   Criminal Damaging. Whoever violates Section 925.43 shall be prosecuted, as is legally appropriate, for violation of Section 541.03 of the Codified Ordinances or Ohio R.C. 2909.06.
