(A) Purpose. Bin storage containers shall be regulated in accordance with the following sections in order to protect adjacent property from the incompatible location and manner of bin storage placement, and to prevent objectionable or offensive conditions which may result from the placement of bin storage containers.
(B) Regulations. Bin storage containers may be allowed by conditional use permit in commercial districts and as an accessory use in industrial districts provided the following:
(1) Total storage capacity does not exceed 200 bushels or 250 cubic feet.
(2) Minimum setbacks in the applicable zoning district for primary structure on the same lot are met unless additional open space is determined to be required by the Board of Adjustment.
(3) (a) Bin storage containers shall be screened from adjacent residentially zoned property by a berm, existing buildings on the property, trees, fences, walls, or hedges in a manner and location as determined by the zoning officer.
(b) Exception: The zoning officer may allow bin storage containers upon a lot adjacent to residentially zoned property if written consent is provided with the application.
(4) The Board of Adjustment may require additional conditions if deemed necessary to protect adjacent property, prevent objectionable or offensive conditions, or to promote the health, safety, and general welfare of the city.
(C) Applications. In addition to information required for all applicable applications, bin storage container applications shall include:
(1) Preliminary site plan identifying the location of screening materials, diameter, and/or area and the general location of the bin storage containers in reference to existing structures, property lines, access locations, and the like, and the general location where vehicles used in the process of loading or unloading the bins will occur;
(2) Map identifying land uses of adjoining properties. This map may be combined with the preliminary site plan referenced in division (D)(1) below;
(3) Description and/or photo identifying the siding material, height, maximum capacity in cubic area, or number of bushels of the bin storage container, and description of materials to be stored; and
(4) Description and/or photo identifying the type of screening proposed, construction materials of any fences or buildings if used, height of any berms, fences, walls, or hedges. If no screening is proposed, a description of why the applicant does not deem screening necessary may be required.
(D) Additional permits required.
(1) After any conditional use permit for bin storage containers is granted, a building permit shall still be required for each bin storage container the first time it is placed on the property. No future building permits will be required if a bin storage container which has already been issued a building permit is moved within the area designated in the preliminary site plan referenced in this section.
(2) Any bin storage container moved onto the property which is not “new” shall be required to meet the requirements of § 154.396(B)(8).
