9-3-5: PRIVATE SEWAGE DISPOSAL SYSTEMS:
   A.   Private Systems Permitted: Where a public sanitary sewer is not available under the provisions of subsection 9-3-4D of this chapter, the building sewer shall be connected to private sewage disposal system complying with the provisions of this section.
   B.   Permit Requirements:
      1.   Permit Required: Before commencement of construction of a private sewage disposal system, the owner shall first obtain a written permit signed by the county health department. A copy of this permit must be forwarded to the village.
      2.   County Approval Required: A permit for a private sewage disposal system shall not become effective until the installation is completed to the satisfaction of the county health department.
   C.   Compliance With State Regulations; Lot Size: The type, capacities, location, and layout of a private sewage disposal system shall comply with all recommendations of the Illinois private sewage disposal licensing act and code and with the state of Illinois environmental protection agency. No permit shall be issued for any private sewage disposal system employing subsurface soil absorption facilities where the area of the lot is less than thirty thousand (30,000) square feet (2,787 square meters).
   D.   Discharge To Natural Outlet: No septic tank or cesspool shall be permitted to discharge to any natural outlet.
   E.   Maintenance Required: The owner shall operate and maintain the private sewage disposal facilities in a sanitary manner at all times and at no expense to the village.
   F.   Availability Of Public Sewer; Connection Required:
      1.   At such time as a public sewer becomes available to a property served by a private sewage disposal system, as provided in subsection 9-3-4D of this chapter, a direct connection shall be made to the public sewer in compliance with this chapter, and any septic tanks, cesspools, and similar private sewage disposal facilities shall be abandoned and filled with suitable material.
      2.   When a public sewer becomes available, the building sewer shall be connected to said sewer within ninety (90) days, and the private sewage disposal system shall be cleaned of sludge and filled with clean bank run gravel or dirt.
   G.   Additional Requirements: No statement contained in this section shall be construed to interfere with any additional requirements that may be imposed by the county health department. (Ord. 1023, 6-15-1992)
