4-2-22: SUSPENSION OR REVOCATION OF LICENSE:
   A.   Grounds: The village president may suspend or revoke any license issued hereunder for any one or more of the following circumstances:
      1.   When the village president is satisfied that a licensee has violated any of the provisions of this chapter, or that the licensee is in violation of any building or fire code, or of any valid resolution enacted by the village board of trustees or any applicable rule or regulation established by the village president that is consistent with law.
      2.   The violation by the licensee of any law of the state of Illinois relating to the regulation of the sale of alcohol.
      3.   The wilful making of any false statement by the licensee as to a material fact in any application for a license hereunder.
   B.   Procedure: No such license shall be revoked or suspended except after a public hearing before the village president acting as local liquor control commissioner. Notice of said public hearing shall be in writing and shall be personally served upon the licensee at least three (3) days prior to the date set for said public hearing and shall notify the licensee that he or she shall have an opportunity to appear at said hearing and defend the charges against him or her. All such hearings shall be open to the public, and all evidence shall be reduced to writing, and the local liquor control commissioner shall maintain an official record of the proceedings. The local liquor control commissioner shall, within five (5) days after such hearing, if he determines that after such hearing the license should be revoked or suspended, state the reason or reasons for such determination in a written order, together with the period of suspension, or that the license has been revoked and shall serve a copy of such order within the five (5) days upon the licensee.
   C.   Appeal: Any order or action of the village president acting as the local liquor control commissioner revoking or suspending a license may, within twenty (20) days after notice of such order or action being appealed from by the licensee or any resident of the village or any person interested, be appealed to the state commission. The appeal shall be limited to a review of the official record of the proceedings of such local liquor control commissioner.
   D.   Commissioner Determination: When sufficient grounds are established to warrant either suspension or revocation of the liquor license, the determination as to whether the penalty for the violation will be suspension or revocation shall be determined at the sole discretion of the liquor control commissioner.
   E.   No License Fee Refunds: In the event that a license issued under this chapter is suspended or revoked, no licensee shall be entitled to any refund of any license fee paid prior to the suspension or revocation, regardless of whether the license is ultimately reinstated or reissued.
