Under-speed vehicles and utility vehicles shall be permitted to travel on roads, streets, alleys and other throughways in the Village of Milan on roads and streets where the speed limit
is thirty-five (35) miles per hour or less, subject to the following conditions:
(a) No person shall operate a under-speed vehicle (golf cart) or utility vehicle on the roads, streets, alleys and other through ways within the Village of Milan unless the under-speed vehicle (golf cart) or utility vehicle has been inspected by the Chief of Police or designee for compliance with the State of Ohio's statutory requirements that are applicable to motor vehicles.
(b) The owner or operator of any under-speed vehicle (golf cart) or utility vehicle shall be required to pay an inspection fee as established by the Chief of Police. If the Chief of Police or designee determines that the under-speed vehicle (golf cart) complies with the State of Ohio's statutory requirements that are applicable to motor vehicles, the Chief of Police or designee shall issue the owner or operator a certificate of compliance entitling the owner or operator to operate the under-speed vehicle (golf cart) or utility vehicle on the roads, streets, alleys and other throughways within the Village of Milan. The owner or operator shall also show the Chief of Police or designee proof of liability insurance for the under-speed vehicle (golf cart) or utility vehicle before a certificate of compliance is issued.
(c) The under-speed vehicle (golf cart) or utility vehicle shall be registered in accordance with Chapter 4503 of the Ohio Revised Code and shall be titled in accordance with Chapter 4505 of the Ohio Revised Code.
(d) Any child who falls under the child restrain criteria set by Ohio R.C. 4511.81 is prohibited from being a passenger in an under-speed vehicle (golf cart) or utility vehicle on any Village roads, streets, alleys, other throughways, right of way or public area in the Village of Milan. (Children who are up to four (4) years old and less than forty (40) pounds which are required to be in a child safety seat or any child who is eight (8) years old or less and under four feet nine inches (4'9") in height who are required to be in a booster seat).
