The Building Inspector shall have the following duties:
(a) Right of Entry and Inspection.
(1) The Building Inspector or any authorized assistant may at any reasonable hour, enter any dwelling, multi-family dwelling, building, structure or premises within the Village to perform any duty imposed on them by this Building Code, provided that permission to enter is obtained from the occupant or, in the case of unoccupied property, from the owner or his agent. If such permission is refused or is otherwise unobtainable, a search warrant shall be obtained before such entry or inspection is made, except in the case of an existing emergency in which case entry may be made at any time and no search warrant is necessary.
(2) No person shall refuse to permit such emergency entry or inspection, nor shall any person hinder, obstruct, resist or abuse any person making or attempting to make such entry or inspection.
(b) In questions of construction, alteration, addition or repair, or the use of any material not covered by this Code, the Building Inspector shall serve as Referee, but in case of disagreement, the decision of the Board of Zoning Appeals shall be final.
(c) When such applications, plans, drawings and specifications conform to the requirements of the Building Code and Zoning Ordinance, the Building Inspector shall fix the fee as provided by the Regulations of the Village and endorse his approval upon such applications. Upon the payment of the fee, he shall issue a building permit.
(d) If the work for which any building permit has been issued is not being performed in conformity with the Building Code or with a detailed statement, plan, drawings or specifications upon which such permit was issued, such work shall be suspended forthwith and no person shall proceed further with such work, and it shall be the duty of the Building Inspector to notify the owner or his agent that the work is being performed in violation of the Building Code, and such work must be suspended forthwith. A written notice of the suspension of such work shall be posted upon such building or structure, and no person shall perform any work on or about such structure or building until such notice has been rescinded by the Building Inspector.
