(a) Within forty-five (45) days of the filing of an application for site plan review and approval, the Zoning Inspector shall transmit the application to the Clerk of the Planning Commission and the application shall be placed on the Planning Commission's agenda for consideration.
(b) The Planning Commission shall consider the application and shall approve, approve with conditions, or disapprove the site plan within forty-five (45) days beginning with the date of the meeting at which it first considered the application. Failure to act within such period shall be deemed approval.
