(A) An appeal from a final order of a Code Enforcement Board following a hearing conducted pursuant to § 153.09(E) may be made to the Woodford County District Court within 30 days of the date the order of the Board is issued. The appeal shall be initiated by the filing of a complaint and a copy of the final order in the same manner as any civil action under the Kentucky Rules of Civil Procedure.
(B) If no appeal from a final order of the Code Enforcement Board is filed within the time period set in division (A) above, the Code Enforcement Board's order shall be deemed final for all purposes.
(C) Any individual who fails to adhere to a final order of the Code Enforcement Board shall be issued a second citation and ordered to appear before the Code Enforcement Board for violation of the Board Order, which shall be processed as an additional and separate violation to any remaining violations on the property and processed as a civil penalty.
(D) Any individual who fails to adhere to 2 consecutive final orders shall be issued a third citation and processed with a criminal penalty and shall not qualify as a civil penalty, thus resulting in the filing of a misdemeanor offense with the Woodford District Court is discussed in § 153.13(C).
