§ 52.20 WATER BILL ADJUSTMENT.
   (A)   In the event of a leak in the water line of a customer, stemming from the customer’s connection to the city water line and running up to and including anywhere on the customer’s premises, an adjustment in the customer’s water bill may be made on the following conditions:
      (1)   The customer seeking adjustment must present written proof to the city’s Water and Sewer Superintendent advising of the leak and indicating the location of the leak;
      (2)   The city’s Water and Sewer Superintendent or his or her assistant shall be provided the opportunity to inspect the line and location of the leak before repairs are made; and
      (3)   The customer shall provide the city’s Water and Sewer Superintendent with written proof verifying that the leak has been repaired describing the nature of the repair, including materials used and that the repair was made in compliance with applicable code requirements.
   (B)   Upon proof and compliance with the above, the city may average the customer’s water bill for the previous 6 water bill periods and bill the customer at the city rate equal to their average water usage for the previous 6 water bills, and for water delivered and lost greater than the 6 month average may adjust the bill to be charged at a rate equal to the Kentucky American Water Company (KAWC) wholesale rate.
   (C)   A customer shall be entitled to an adjustment for water loss due to a water line leak no more than 1 time during a 12 month period from the date that proof of verified repair was last made for the premises and the date of discovery of any later water line leak.
   (D)   Adjustments for water bills shall not be permitted for any customer where the premises has been unoccupied for longer than 3 months or for any customer at the address who is delinquent in paying their water bill for more than 60 days before the water leak is discovered.
   (E)   The final decision on any request for adjustment of a water bill for leaks shall be made by the city’s Water and Sewer Superintendent with approval by the City Council.
