(A) A person, corporation, partnership, association or other entity who violates section 8-5-3 of this chapter shall be fined pursuant to this section. Each day that a violation occurs is a separate violation.
(B) A person who smokes in an area where smoking is prohibited under section 8-5-3 of this chapter shall be fined in an amount that is not less than one hundred dollars ($100.00) and not more than two hundred fifty dollars ($250.00).
(C) A person who owns, operates, or otherwise controls a public place or place of employment that violates section 8-5-3 of this chapter shall be fined: 1) not less than two hundred fifty dollars ($250.00) for the first violation; 2) not less than five hundred dollars ($500.00) for the second violation within one year after the first violation; and 3) not less than two thousand five hundred dollars ($2,500.00) for each additional violation within one year after the first violation.
(D) A fine imposed under this section shall be allocated as follows:
1. One-half (1/2) of the fine shall be distributed to the Illinois department of public health; and
2. One-half (1/2) of the fine shall be distributed to the village. (Ord. 1660, 1-23-2008)
