(A) Upon discovery of a violation of this chapter regarding excess garbage or refuse, the village, by any duly authorized agent, shall serve or cause to be served a notice of violation upon the owner or occupant of any premises on which garbage is overflowing or the surrounding areas are not clean and free of garbage, and shall demand the abatement of the nuisance within twenty four (24) hours.
(B) In the event the nuisance referred to in subsection (A) of this section is not abated within twenty four (24) hours, the village may proceed to abate the nuisance by removal of the garbage. The owner or occupant shall be responsible for all costs of such abatement including all legal and administrative fees. The minimum charge for such abatement shall be two hundred dollars ($200.00).
(C) Upon discovery of any other violations of this chapter, the village, by any duly authorized agent, shall serve or cause to be served a notice of violation upon the violator.
(D) Any person convicted of violating this section shall be fined not less than fifty dollars ($50.00) nor more than seven hundred fifty dollars ($750.00). Each day the violation continues shall be considered a separate violation of this section.
(E) Neither the village or any of its agents shall be liable for any damage to property occasioned in the enforcement of this section. (Ord. 1817, 12-12-2012)
