8-2-9: LOCATION OF RESIDENTIAL GARBAGE CONTAINERS AND TEMPORARY CONSTRUCTION DUMPSTERS:
   (A)   For single- or two-family residential dwellings all refuse, recycling and landscape toters, as well as all refuse, recycling and landscape containers ("garbage containers") shall be kept in the rear of the principal building on the lot, except when it is necessary to place the same in the parkway for purposes of garbage collection. On the day preceding the collection of refuse, recycling or landscape materials, residents shall be permitted to place garbage containers in the parkway no earlier than nine o'clock (9:00) A.M. Any and all garbage containers shall be removed from the parkway no later than nine o'clock (9:00) A.M. on the day immediately following the collection of refuse, recycling or landscape materials.    (B)   Any drop-off/roll-off construction dumpster used on a temporary basis for construction, roofing, concrete removal, remodeling, cleanup, landscaping or other uses shall be placed on private property only. If such placement is impossible or impractical, placement of the construction dumpster on the street will be allowed by a special permit that must be obtained from the building department. Permits will be granted only when it is determined by the building department that the placement of the construction dumpster on private property is impossible or impractical. The term of the special permit to place a construction dumpster on the street shall be one week. Extensions of the permitted term may be made by the building department. Any construction dumpster that has been positioned on the street must be protected by at least two (2) barricades which have been equipped with a flashing warning light and placed in a manner that is conspicuous to traffic approaching from either direction. The barricades shall be made available at the department of public works for a nominal fee and a refundable deposit that is equal to the cost of replacement. It is the obligation of the owner of the property, any contractor using the construction dumpster and the owner of the construction dumpster to make sure this section is complied with.
