5-1-5: FEES:
   (A)   All fees and charges for licenses or permits shall be paid in advance to the village clerk at the time the license application is filed. Any business in operation by January 1 of any license year shall obtain its license by January 7 of the same license year. When the license is issued after January 7 of the license year for business in operation on January 1 of the license year, the license fee shall be double the rate as set forth in the village ordinance. If a new business starts after July 1 of a license year, the license for the remainder of the year shall be issued upon payment of one-half (1/2) the annual fee.
   (B)   Notwithstanding the provisions in subsection (A) of this section, all business license fees and fee payment schedules for hotels, motels, hotel clubs, motel clubs or rooming houses are provided below:
      1.   Upon the issuance of an occupancy permit (in the case of new construction) or a business license for a new hotel, motel, hotel club, motel club or rooming house, the business license fee shall be due on February 1 in the amount of thirty five thousand dollars ($35,000.00). If an occupancy permit (where new construction occurs) or a business license application for a new hotel, motel, hotel club, motel club or rooming house is submitted after February 1, the fee will be a prorated amount from the date the application is submitted.
      2.   With regard to a hotel, motel, hotel club, motel club or rooming house, the calendar year will be the year of operation (January 1 through December 31). Business license fees shall be due on February 1 of the year following the first full calendar year of operation.
      3.   The greater of thirty five thousand dollars ($35,000.00) or four percent (4%) of room revenues generated during the first full calendar year shall be due on February 1 of the subsequent year for the business license fee.
      4.   The greater of thirty five thousand dollars ($35,000.00) or four and one-half percent (4.5%) of the room revenues generated during the second full calendar year shall be due on February 1 of the subsequent year for the business license fee.
      5.   The greater of thirty five thousand dollars ($35,000.00) or five percent (5%) of room revenues generated during the third full calendar year shall be due on February 1 of the subsequent year for the business license fee.
      6.   The greater of thirty five thousand dollars ($35,000.00) or four percent (4.0%) of the room revenues generated in the prior year for each year thereafter, shall be due on February 1 for the business license fee.
      7.   Along with the filing by the developer of its business license application, business license fee as stated above, the developer shall also be required to submit a financial report showing room revenues for the prior calendar year, which shall be certified as being accurate and shall be notarized. Thereafter, the developer shall, on or before April 30 of each year, submit a copy of the developer's tax return with the page showing room revenues for the prior calendar year to the village, with a similar notarized certification of the accuracy of said page of tax return.
