4-8-2: RESIDENTIAL CODE ADOPTED:
   (A)   Code Adopted: The 2018 Residential Code as published by the International Code Council, is hereby adopted and incorporated in full as if set forth at length herein, and shall apply and control within the Village of Midlothian, save and except such portions as hereinafter deleted, modified or amended.
   (B)   Other Code References: References to other International Codes herein shall mean and apply as follows:
      1.   International Building Code (IBC) as adopted and amended by the Village of Midlothian.
      2.   References to the International Existing Building Code are hereby deleted.
      3.   International Fire Code (IFC) references shall be deleted and replaced with the National Fire Code, 2009 edition published by the National Fire Protection Association, the National Fire Protection Association Code (NFPA) #1, 2009 edition, the National Fire Protection Association Code 101, Life Safety Code, 2009 edition and their subsequent revisions and the whole thereof, except such portions pertaining to the organization, administration, operation, and equipment of the Fire Department and such portions as are otherwise inapplicable to the Village, or as are hereinafter deleted, modified or amended by the Village of Midlothian.
      4.   International Plumbing Code (IPC) references shall be deleted and replaced with the Illinois Plumbing Code as adopted and amended by the Village of Midlothian.
      5.   International Residential Code (IRC) as adopted and amended by the Village of Midlothian.
      6.   International Mechanical Code (IMC) and the International Fuel Gas Code (IFGC) as adopted and amended by the Village of Midlothian.
      7.   References to the International Private Sewage Disposal Code are hereby deleted and replaced with the provisions of title 3, chapter 5 of the Village Code.
      8.   International Property Maintenance Code as adopted and amended by the Village of Midlothian.
      9.   References to NFPA 70 - the National Electrical Code are hereby deleted and replaced with the provisions of the 2017 Chicago Electrical Code as adopted and amended by the Village of Midlothian.
      10.   References to Accessible and Usable Buildings and Facilities are hereby deleted and replaced with the Illinois Accessibility Code as adopted by the Village of Midlothian.
   (C)   Amendments: The following amendments to the 2018 edition of the International Residential Code, shall apply:
      1.   Section 101.1 shall name the Village of Midlothian as the jurisdiction and shall state the following: These regulations shall be known as the Residential Code for One and Two-family Dwellings in the Village of Midlothian, hereinafter referred as the "Residential Code."
      2.   Section 101.2 referencing Scope Exception is hereby amended to reference 4-15-4 of the Village of Midlothian Fire Code and to state that Single Family homes do not require sprinkler systems.
      3.   Section 105.2 referencing work not requiring a permit shall delete numbers 1, 2, 3, 4, 5, 9 and 10 and these numbered items shall require permits in the Village of Midlothian.
      4.   Section 105.2.1 referencing Emergency Repairs shall be amended to provide the following: Application for a permit must be made for all repair work requiring permits under this Building Code however, where equipment replacement and repairs must be performed in an emergency situation, the permit application shall be submitted within the next business day to the building official.
   Maintenance items such as painting, sealing, decorating and repair related/home improvements are not considered to be repairs and do not require that a fee be paid. Such repairs shall not include the cutting away of any wall, partition or portion thereof, the removal or cutting of any structural beam or load-bearing support, or the removal or change of any required means of egress, or rearrangement of parts of a structure affecting the egress requirements; nor shall ordinary repairs include addition to, alteration of, replacement or relocation of any standpipe, water supply, sewer, drainage, drain leader, gas, soil, waste, vent or similar piping, electric wiring or mechanical or other work affecting public health or general safety.
      5.   Section 106.3.3 shall be amended to add the following paragraph: Requests for phased development permits shall have the phases clearly outlined in the permit application with expected dates for beginning of construction and date of completion of construction of each phase. The payment of the fee for phased construction shall not relieve the applicant or holder of the permit from payment of other fees that may be prescribed by statute, resolution or ordinance for water taps, sewer connections, electrical permits, erection of signs or other fees, inspections, certificates of use and occupancy or other privileges or requirements in the Village of Midlothian.
      6.   Section 112.1 referencing Board of Appeals is hereby amended to designate the Village Board of the Village of Midlothian as the Board of Appeals and to provide that the Village board shall adopt rules of procedure for conducting its appeal functions and issue all decisions and findings in writing.
      7.   Section 112.3 referencing Qualifications is hereby deleted.
      8.   Section 301.2(1) referencing Table of "Climatic and Geographic Design Criteria" is hereby amended to insert the following designations:
         Ground Snow Load: 25
         Wind Design Speed: 90 mph
         Topographic effects: No
         Special wind region: No
         Windborne debris zone: Exposure `B'
         Seismic Design Category: A
         Subject to Damage From Weathering: Severe
         Frostline depth: 42"
         Termite: Moderate to heavy
         Winter Design Temp: Zero
         Ice and water Shield: Yes
         Air Freezing Index: 1433
         Mean annual Temperature: 50.6 degrees
      9.   Section 301.2.2.5 shall be amended to add a Section 301.2.2.5.1 as follows:
         301.2.2.5.1 Cold weather concrete.
         1.   Definitions and requirements: Cold weather is defined as a period when one of the following conditions exists for more than three consecutive days:
            a.   Average air temperature is less than forty (40) degrees Fahrenheit;
            b.   Air temperature is less than forty (40) degrees Fahrenheit for more than one-half of any twenty-four (24) hour period. Average air temperature is the average of the highest and lowest temperatures occurring during the period from midnight to midnight. After the first cold weather condition or after December 1, whichever comes first, all concrete will be subject to the cold weather requirements until April 1.
            c.   Footings shall be poured on frost free soil and in compliance with ACI 306R.88. concrete shall be protected in forms for not less than two days and covered with insulation blankets.
            d.   Foundations shall be poured and protected in compliance with ACI 306R.88. The length of protection shall be as required in Table 5.3 and shall be covered with insulation blankets a minimum of three days. The insulation blankets shall extend from the top of the wall to the base of the footings.
            e.   Interior concrete floors, elevated decks and roofs shall be poured and protected in compliance with ACI 306R.88. All concrete floors shall be protected and covered with insulation blankets and temperature maintained at 50 degrees Fahrenheit. If supplemental heat is required to maintain minimum temperatures, U.L. listed, vented-type heaters are permitted, provided the unit is vented to the exterior of the building. Vented boilers, radiant heat and propane units are permitted provided the unit is equipped with a carbon monoxide cut-off switch. The use of salamanders (torpedo heaters) or other equipment that expel flue gases into the area above concrete floors are prohibited to avoid carbonation of fresh concrete.
            f.   Exterior flatwork is not permitted during the period of December 1, until April 1 without approval of the Village of Midlothian building Superintendent.
            g.   All concrete that is poured during cold weather conditions shall require on-site testing and inspections by a third-party testing agency in accordance with ACI 306R.88. A cold weather concrete plan shall be required from the general contractor indicating the inspection schedule, testing procedures and also a list of any admixtures that are proposed to accelerate curing.
      10.   Section 309.3 referencing Flood hazard areas is hereby deleted.
      11.   Section 313 referencing Automatic Sprinkler Systems is hereby deleted and replaced with the provisions of 4-15-4 of the Village of Midlothian Municipal Code.
      12.   Section 326 referencing Swimming Pools, Spas and Hot Tubs is hereby deleted and the provisions of 4-5-1 of the Village Code shall apply.
      13.   Sections 402 and 403 referencing Materials and Footings respectively is hereby amended to prohibit the use of wood foundations, wood footings, crushed stone footings, rubble foundations and require all concrete walls shall be mechanically formed in accordance with ACI 318 and ACI 306 with the exception of: (a) Monolithic slab on ground with turn down footing; (b) Thickened slab on ground footing at bearing wall lines.
      14.   Section 404 referencing Rubble stone masonry foundations and Wood foundation walls is hereby amended to prohibit their use in the Village of Midlothian.
      15.   Section 504 is hereby deleted to prohibit the use of Pressure Treated Preservative Wood on ground in the Village of Midlothian.
      16.   Section 506 Referencing Minimum slab provisions is replaced in its entirety with the following provisions:
         506 General.
         The thickness of concrete floor slabs in crawl spaces supported directly on the ground shall not be less than two (2) inches. The thickness of concrete floor slabs of concrete basement floors shall be not less than four (4) inches. The minimum thickness of all concrete exposed to freezing and thawing conditions, including garage floors, shall be a minimum of five (5) inches with 6 x 6 W.W.F. installed at the mid-point of slab thickness. The minimum thickness of concrete floors in slab on grade construction shall be a minimum of five (5) inches with 4 x 4 W.W.F. installed at the mid-point of slab thickness. All exposed concrete shall be a minimum six (6) bag mixture with an air entrainment of four (4) percent to seven (7) percent and achieve a minimum compressive strength of 3,500 psi after 28 days. Fibrous concrete reinforcement shall be permitted in lieu of welded wire fabric reinforcement when installed in accordance with manufacturer's specifications and field verification. A 6-mil polyethylene vapor retarder with joints lapped not less than 6 inches shall be placed between the base course or subgrade and the concrete floor slab, or other approved equivalent methods or materials shall be used to retard vapor transmission through the floor slab. A vapor retarder is required for slab on grade construction. A 15-mil polyethylene vapor retarder with joints lapped not less than 6 inches and taped shall be placed between the base course or sub grade and the concrete floor slab.
         Exception: A vapor retarder is not required:
         a.   For detached structures accessory to occupancies in Group R-3, such as garages, utility buildings or other unheated facilities.
         b.   For unheated storage rooms having an area of less than 70 square feet and carports attached to occupancies in Group R-3.
         c.   For buildings of other occupancies where migration of moisture through the slab from below will not be detrimental to the intended occupancy of the building.
         d.   For driveways, walks, patios and other flatwork which will not be enclosed later.
      17.   Section 507 referencing Decks is deleted and replaced with the provisions of the "American Wood Council DCA #6 Prescriptive Residential Wood Deck Construction Guide" for decks under 6 feet in height from the ground and the provisions of City of Chicago "Porch Design and Construction Guidelines" for decks in excess of 6 feet in height from the ground.
      18.   Section 606 referencing Rubble stone masonry walls is deleted to prohibit their use in the Village of Midlothian.
      19.   Section 905.5 referencing Mineral surfaced roll roofing is deleted to prohibit its use in the Village of Midlothian.
      20.   Part VII, Chapters 25 through 33 referencing Plumbing are hereby deleted.
      21.   Part VIII, Chapter 34 through 43 referencing Electrical are hereby deleted.
      22.   The following Appendices of the IRC are hereby adopted in the Village of Midlothian:
         Appendix E referencing Manufactured Housing as regulated by 11-9-2 and 11-5-2 of the Village Code.
         Appendix F referencing Rodent Proofing
         Appendix G referencing Flood Resistant Construction
         Appendix H referencing Patio Covers
         Appendix J referencing Existing Buildings and Structures
