§ 152.007 CITY IDENTIFICATION SIGNAGE.
   (A)   Creation of new city identification signage. The city recognizes that there is an opportunity to create better public identification for both the City of Middletown and its business community through the construction of City of Middletown identification signs. These signs may be built with additional space for city businesses and organizations. On a case-by- case basis, the city will consider appropriate and non-intrusive signage in its right-of-way, or on land to be deeded to the city, or on private property, as long as the following initial criteria are met;
      (1)   The sign is proposed in an area in which City of Middletown identification is needed and the sign will fulfill that need;
      (2)   The primary purpose of the sign is city identification, with additional space allowed for business signage;
      (3)   Total initial capital cost of the sign must be paid by others;
      (4)   The sign must be safe, not adversely impact traffic and be constructed to all city specification;
      (5)   There is a signed agreement and easement in place which determines responsibility for future maintenance.
   (B)   Control of sign/construction. The city must approve the final design, location, size and construction details of the sign, after submittal by the applicant(s). The city will enter into an agreement with the applicant(s) that determines future control and maintenance issues.
