(A) The city does hereby accept from the Board of Trustees of the Middletown Cemetery Association, Inc. the full and complete substitution of the city, acting by and through its City Commission.
(B) The city shall use its best efforts to see that the (new) Middletown Cemetery Association, Inc. is operated in accordance with the articles of incorporation and bylaws of Middletown Cemetery Association, Inc.
(C) The business of Middletown Cemetery Association, Inc. shall be conducted by the Board of Trustees, consisting of the Mayor and the City Commissioners.
(D) The funds of Middletown Cemetery Association, Inc. shall not be commingled with city funds.
