§ 91.05 CONSTRUCTION, MAINTENANCE OF CHIMNEYS, INCINERATORS, AND THE LIKE.
   (A)   All chimneys, smokestacks or similar devices for conveying smoke or hot gases to the outer air and the stoves, furnaces, restaurant type cooking equipment, incinerators, fire boxes or boilers to which they are connected shall be constructed and maintained in such a manner as not to create a hazardous condition.
   (B)   Commercial and industrial type incinerators used for burning of rubbish or other readily combustible solid waste material and flue-fed incinerators shall be provided with spark arresters or other effective means approved by authority of the state or the Fire Chief for arresting sparks and fly particles.
