331.44 OPERATION OF UNDERSPEED VEHICLES.
   (a)   Definition:  An "Under Speed Vehicle" is a motor vehicle as the term is defined under Ohio R.C. 4501.01(B). Any Under Speed Vehicle operated within the Village of Middleport shall have a maximum attainable speed of twenty miles per hour or less.
   (b)   Equipment:  In addition to any rules or regulations promulgated by the Ohio Director of Public Safety, pursuant to Ohio R.C. Chapter 4511 and O.R.C. Chapter 4513,  required equipment on an Under Speed Vehicle shall include, but not be limited to the following items of equipment; all to be in working order during operation:
      (1)   Two headlights having a minimum candlepower of sufficient intensity to reveal persons and objects at a distance of at least 100 feet ahead under normal atmospheric conditions during hours of darkness.
      (2)   Two red tail lights having a minimum candlepower of sufficient intensity to be plainly visible from a distance of at least 500 feet to the rear under normal atmospheric conditions during hours of darkness.
      (3)   Must have directional signals.
      (4)   Must have left side rear view mirror and a rear view mirror.
      (5)   Must have a white light illuminating the rear license plate.
      (6)   Must have a horn.
      (7)   Must have a windshield made of glass or safety glass and working wiper blade.
      (8)   Must have two license plates, one in the front and one in the rear, bracketed to the cart
      (9)   Must have brake lights.
      (10)   Must have one seat belt per occupant.
      (11)   Must have all child restraint restrictions outlined in the Ohio R.C. 4511.81.
   (c)   Inspection: The owner of the Under Speed Vehicle must obtain a Meigs County Sheriff's Office Inspection Certificate before operating said vehicle within the Village of Middleport.  Proof of inspection must remain with the vehicle.
         
   (d)   Licensing Requirements of Operator:
      (1)   Must have a valid Ohio driver's license.
      (2)   No person who is less than 18 years of age shall operate an Under Speed Vehicle within the Village of Middleport.
   (e)   Insurance:  The owner of the Under Speed Vehicle must show proof of insurance at the time of inspection and carry proof of insurance at all times.
   (f)   Operation of Under Speed Vehicles:
      (1)   The driver of an Under Speed Vehicle shall obey all traffic rules applicable to vehicles while operating within the Village of Middleport.
      (2)   Headlights must be in use at all times while the Under Speed Vehicle is in motion.
      (3)   No person shall operate an Under Speed Vehicle on Mill Street, General Hartinger Boulevard, Powell Street, North or South Second Avenue or North or South Third Avenue except to cross at a intersection to traverse to a different Village street or to access the closest local street or alleyway.
      (4)   Temporary permission may be obtained from the Chief of Police to operate on the prohibited streets in subsection (f)(3) hereof for a limited time during special events, such as parades.
      (5)   Occupants of an Under Speed Vehicle shall be seated at all times on the seat of the vehicle wearing a buckled seat belt when the vehicle is in motion.  Standing on any portion of the vehicle while it is in motion is prohibited.
      (6)   No person shall operate an Under Speed Vehicle on sidewalks, walkways or paths.
      (7)   No person shall operate an Under Speed Vehicle in any village park.
      (8)   No person shall operate an Under Speed Vehicle in any village cemetery.
   
   (g)   Penalty:  That anyone who violates this ordinance shall be guilty of a minor misdemeanor.  If, within one year of an offense, the offender previously has been convicted of or plead guilty to a previous violation of this ordinance, whoever violates this  ordinance is guilty of a misdemeanor of the fourth degree.  If, within one year of the offense, the offender previously has been convicted of two or more prior violations of this ordinance, whoever violates this ordinance is guilty of a misdemeanor of the third degree.  (Ord. 66-11.  Passed 7-18-11.)
