157.01  TREE AUTHORITY BOARD.
   (a)   Whereas a Tree Authority Board has been created and established by Resolution No. 473, dated June 24, 1991, and such Authority does consist of five members, residents of the Village, having been appointed by the Mayor with the approval of Council.
   (b)   The term of the five persons appointed by the Mayor shall be three years, except that the term of two of the members appointed to the first board shall be only one and two years respectively.  In the event that a vacancy shall occur during the term of any member, his successor shall be appointed for the unexpired portion of such term.
   (c)   Members of the Board shall serve without compensation.
   (d)   The Board shall have power to study, investigate, plan, advise, report and recommend to Council and the Mayor any action, program, plan or legislation which the Board shall find or determine to be necessary or advisable for the care, preservation, trimming, planting, replanting, removal or disposition of trees and shrubs within street rights-of-ways, parks and public places of the Village.
   (e)   The Board shall choose its own officers, make its own rules and regulations and keep a journal of its proceedings.  A majority of the members shall be a quorum for the transaction of business.  All plans, findings, advice, reports and recommendations made by the Board shall be in writing and designate by name those members of the Board approving or concurring therein, and members  who do not so approve or concur therein shall have the right, as part of such report, to state their reasons for refusing to approve or concur.
   (f)   The Board, when requested by Council or the Mayor, shall reconsider, investigate, make findings, report and recommend upon any special matter of question coming within the scope of its work.
   (g)   No person shall hereafter plant any tree or shrub upon any public way, street or alley unless he shall have first obtained a permit in writing from the Village specifying the size, type, species and location on the public way, street or alley, of the tree or shrub to be planted.
   (h)   Any person violating the provisions hereof shall be fined not more than fifteen dollars ($15.00) and the costs of prosecution.
   (i)   Council and/or Mayor shall deny a permit to any person who proposes to plant any tree or shrub upon a public way, street or alley of any size, type or species found to be undesirable by the Tree Authority Board or so found to be undesirable for the location proposed; or deny a permit to any person who proposes to plant any tree or shrub upon a public way, street or alley if at a location found by the Board to be of a size or type unsuitable for planting trees or shrubs.
