905.02  PERMIT APPLICATION, REQUIREMENTS, FEE AND ISSUANCE.
   Whoever intends to tap or in any manner make a connection with any water or gas main or pipe, sewer, or electrical or telephone underground or conduit service, shall before excavating or digging in any street, alley or sidewalk, file with the Mayor a plat, showing the location, length, width and depth of the excavation that the party intends to make in such street, sidewalk or alley, together with the length of time that it will take to complete the excavation, construct the connection and restore the street, sidewalk or alley to its former condition for use by the public.
   The applicant shall also pay to the Mayor the following sums:
   (a)    If such improvement is on an unimproved street or alley a permit fee of two dollars ($2.00).
   (b)    If such improvement is on a paved, surfaced, brick or concrete street, sidewalk or alley, the permit fee shall be ten dollars ($10.00).
   In addition the applicant shall sign a contract or obligation that he will, within the time stated in his application, restore all streets, sidewalks and alleys to their former condition for use of the public. The restoration of the street, sidewalk or alley where it is paved shall be done by returning the material removed in making the excavation and thoroughly pounding and tamping the same until the excavation is filled to within ten inches of the top of the dirt, which ten inches shall be filled as follows: the first or lower eight inches shall be gravel and the last two inches upon which the brick is to be replaced shall be sand and each and every brick that is to replace those removed shall be whole "A" No.1 first class brick relaid and replaced in a good workmanlike manner. After the applicant has complied with each and all the conditions set forth above and upon payment of the permit fee the Mayor may grant the applicant a permit to make the excavation and connection as set forth in his application and plat if he is satisfied that such improvement is reasonable and necessary.
   The Mayor shall make a record of such plat and permit, in a book provided for that purpose. If the person obtaining such permit fails or refuses to repair the sidewalk, street or alley as above provided for the period of ten days after the expiration of time mentioned in his permit, he shall be liable to the penalty provided in Section 905.99.
